I am not approving a permit for that site, based on the Phase II
Environmental Assessment for that site, dated March 2015. (Attached)
Section 2.1 REC 1. “The likely presence of unknown solid waste at the
property is considered a moderate to high environmental risk.”
BER 1. “Removal and proper disposal of the waste
would be necessary before the property is suitable for development.”
I can disapprove that project based on the Phase II alone, but we need
a general policy for this topic, for all other sites.
This is just the beginning of trying to build residential structures on
numerous waste-filled sites in the City.
What we do here will set a precedent for those lots.
Attached is a draft memo on the subject and a DEP Guideline.
We have discussed this at our development meetings and the other people
copied here are expecting this draft.
This topic crosses over departments and needs to be a group project.

Hey Shane, here is the email I sent Amanda after it happened. I talked
with Brenna today too, she apparently talked to Dan a couple of weeks
ago, after he told me that. She is trying to find a common ground here
and make sure Dan is heard but she seemed to agree that he can’t do
that.

He said, out loud, that his goal is to have us pull all that trash out
or not build there, and that he was trying to get DEP to give him a
reason that he could do that. When I asked him about following DEP
guidance on levels of contaminants, he once again wouldn’t commit to
using that as the standard. He then also added, and I quote “I don’t
know much about hazardous materials. That is not my forte.”
