additional fill redirects stormwater (and waves) to the adjacent
properties to the north and south.
Regarding the flood zone, they should provide a new survey showing the
AE-9 SFHA and any fill in that flood zone.
The fill is not required to meet coastal construction codes.
The neighbor to the south’s representative called me yesterday and
wanted information and codes regarding the fill along the 1927 southern
lot line.
He said that was more of a concern than the east side.
I sent him that information and I will forward that to you all.

additional fill is to 1.stabilize the property and 2. Create a
stormwater path.
Am I correct that this fill is not required to meet any coastal
construction codes, as the 24-70 states?
Also, will this affect their on-site retention?

Brian - That pretty well summarizes what I recall. A couple of
comments:
Paragraph 1 - I would say that the City issued a building permit
matching what the FDEP permit allows since you specifically say in
paragraph 2 that the City didn't approve the additional fill.
Paragraph 2 - They did not receive City approval, but if my
recollection is correct, they didn't seek City approval prior to placing
the fill.
Paragraph 3.a. - Do they specifically state in the variance application
that the additional fill is for extra protection from storm surge or is
it really just a place for their fire pit? Either way, placing that
extra fill as they did results in stormwater runoff being directed to
neighboring parcels.
This isn't in a coastal high hazard zone (Is that correct Dan?) so the
section of the code dealing with non-structural fill in a coastal high
hazard zone will not apply.

All, I’m writing the staff report for the 1927 Beach Ave variance
request and could use some help. Below is my general summary, let me
know if you see anything incorrect or if I need to change/add anything.
1. Applicants received DEP permit for house, deck, etc. DEP sets
FFE and volume of fill to imported.
2. Applicants received DEP field permit for additional fill
seaward of house but did not receive city approval.
3. Variance required because fill violates Sec 24-70: “Except as
required to meet coastal construction codes as set forth within a valid
permit from the Florida Department of Environmental Protection; or as
required to meet applicable flood zone or stormwater regulations
pursuant to valid permits, the grade, elevation or topography of any
parcel, development or redevelopment site shall not be altered.”
a. Additional fill is not required to meet any coastal
construction codes because it is not required for any structures, it is
just to provide extra protection from storm surge
I expect to be asked about the underlined part, why it doesn’t meet
coastal construction codes.
