AN ORDINANCE AMENDING THE ORDINANCE CODE
OF THE CITY OF ATLANTIC BEACH, FLORIDA;
AMENDING CHAPTER 22, ARTICLE II, TO CREATE
A NEW SECTION 22-40, TO PROVIDE THAT WELLS
WILL REQUIRE A PERMIT FROM THE CITY;
CREATING SECTION 22-41 , TO REQUIRE BACTERIO-
LOGICAL TESTING ON WELLS DESIGNED FOR POTABLE
USE; PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED by the City Commission of the City of Atlantic
Beach, Florida:
Section 1 . Chapter 22, Article II is hereby amended to add section
22-40 and 22-41 which said sections shall read as follows:

UTILITIES
ARTICLE II - WATER WORKS SYSTEM
Section 22-40. Wells, permit required
Any person, firm, corporation, individual or other entity wishing
to dig a water well for any purpose within the corporate limits of the
city of Atlantic Beach must first obtain, therefore, a permit at a cost
of ten dollars ($10.00) from the building department of the city of
Atlantic Beach, Florida.
Section 22-41 . Tests, bacteriological for potable water.
Any person, individual, corporation or other entity receiving a
permit as provided in section 22-40 herein, and who plans to use water
from the permitted well for drinking purposes, must first obtain a
bacteriological test report from the State of Florida Health Department,
furnishing a certified copy thereof to the building department of the
City of Atlantic Beach, Florida.
Section 2. This ordinance shall take effect as provided by law.
