AN ORDINANCE AMENDING THE CODE OF ORDINANCES
OF THE CITY OF ATLANTIC BEACH , ALLOWING FOR
EXTENDED PAYMENT PLANS FOR WATER SYSTEM CONNECTION
AND IMPACT FEES, PROVIDING AN EFFECTIVE DATE .
WHEREAS , Sec . 22-171 of the Code of Ordinances allowed
extended payment of connection fees for existing buildings or
structures for up to five ( 5 ) years for sewer connection fees
and impact fees , and
WHEREAS, the City has increased the maximum allowable time
for such extended payment plans to 15 years, and
WHEREAS , the City desires to make the same allowance
available for water impact fees .
NOW THEREFORE , BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF ATLANTIC BEACH , FLORIDA :
Section 1 . Sec. 22-18 of Chapter 22 , UTILITIES, of the
Atlantic Beach Code , is hereby amended by adding the following:
"Sec. 22-18(e) . Payment of connection fees and
impact fees. Payment of connection fees and impact
fees shall be due and payable prior to the issuance
of a building permit. For new and existing buildings
or structures, the City Mananger may allow payment of
fees on an extended payment plan for up to fifteen
( 15 ) years or the remaining life of an existing
mortgage , whichever is less, if the owner has
demonstrated to the satisfaction of the City Manager
that the lump sum payment will constitute a hardship
to the applicant. A lien for the amount due shall be
executed in recordable form reflecting the payment
schedule, and recorded at the applicant' s expense.
Upon all payments being made in full , the lien shall
be released of record. "
Section 2 . This Ordinance shall take effect immediately
upon its final passage and adoption .
