Ordinance No. 80-96-58 v ORDINANCE NO. 8 0-96-5 8 AN ORDINANCE OF THE CITY OF ATLANTIC BEACH, FLORIDA, AMENDING CHAPTER 22, UTILITIES, SEC. 22-27.1, UTILITY DEPOSITS, BY PROVIDING FOR THE RETURN OF DEPOSITS UNDER CERTAIN CIRCUMSTANCES, AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED by the City Commission of the City of Atlantic Beach, Florida: SECTION 1. Sec. 22-271 of the Code of Ordinances of the City of Atlantic Beach, Florida, is hereby amended to read as follows: "Sec. 22-27.1 Utility deposits. (1) A deposit representing two (2) months' average charges for utility services, i.e., water, sewer and garbage, will be required for all new utility accounts. Upon termination of utility services, the customer's deposit will first be applied to any balances owed on their account. Any balance remaining will be refunded to the customer or transferred to another account upon request of the customer. (2) The deposit of any customer shall be refunded with interest at the rate of three percent (3%) per annum after twenty-four (24) months from the date of deposit, provided the customer is current in all payments and has timely made all payments during the preceding 24 months. If any customer becomes delinquent in payments after his deposit has been refunded pursuant to this section, the city may require an additional deposit for service to continue." SECTION 2.
