CASE NUMBER: 17-511 REAL ESTATE NUMBER: 171090-0040 LEGAL DESCRIPTION: 30-60 38-2S-29E .27 ROYAL PALMS UNIT 01 PT TRACT A RECD O/R ORDER ON CASE No. 17-551 THIS CAUSE came for public hearing before the Code Enforcement Special Magistrate on January 19, 2023, and the Special Magistrate having heard testimony under oath, received evidence, and heard arguments respective to all appropriate matters, issues findings of fact, conclusions of law, and orders as follows: FINDINGS OF FACT 1. Respondent represents the interests of the Property located at 20 Donner Road, Atlantic Beach, Florida. ("The Property"). 2. The Respondent requested a lien reduction on a prior violation from January 2, 2018. The Respondent did not appear. 3. The Respondent's Property was cited and a lien imposed for violation of Chapter 20 Business Tax Receipts, Section 20-52, Section 24-173 Neighborhood Preservation and property maintenance standards and Chapter 24, Land Development Regulations. 4. On November 14, 2017, a fine of$100.00 per day was assessed if the violation continued past January 2, 2018 and payable at an interest rate of ten(10) percent per annum from the date of the certification until paid. The City of Atlantic Beach was approached by the Respondent for a lien reduction. The Respondent requested a continuance until the March 2, 2023 hearing date. CONCLUSIONS OF LAW 5. The City of Atlantic Beach provided time for a hearing for the Respondent on the issue of a lien reduction. The Respondent requested a continuance until the March 2, 2023 hearing date. ORDER Based upon the foregoing Findings of Fact and Conclusions of Law and pursuant to the authority granted in Chapter 162, Florida Statutes, and the Code of Ordinances of the City of Atlantic Beach, Florida it is Ordered: A.
