Ordinance No. 90-60-8 v I n 4. ,1`E ORDINANCE NO. 90-60-8 (IC AN ORDINANCE TO AMEND ORDINANCE NO. 90 59-3 BEING "AN ORDINANCE PROVIDING FOR THE ZONING OF THE CITY OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA FOR THE PURPOSE OF PROMOTING HEALTH, SAFETY, MORALS AND THE GENERAL WELFARE OF THE CITY, UNDER AND PURSUANT TO THE 'ATLANTIC BEACH CHARTER' : PROVIDING FOR THE ENFORCEMENT THEREOF, FIXING PENALTY FOR VIOLATION THEREOF: REPEALING ORDINANCE NUMBER 50 AND ALL ORDINANCES IN CONFLICT THEREWITH AND FIXING THE DATE WHEN SAME SHALL BECOME EFFECTIVE. " BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA. SECTION 1. That the Zoning Map of the City of Atlan;:ic Beach be changed and amended to conform with the attached map entitled "MAP OF CITY OF ATLANTIC BEACH, FLORIDA SHOWING CHANGES IN ZONING AS ESTABLISHED BY ORDINANCE NO. 90-60-8 ", said map is hereby made a part of this ordinance. SECTION 2. Residence A-1 District. 1. Uses . Within any Residence A-1 District, as indicated on the Zoning Map, no building or premises shall be used and no building or structure shall be erected which is intended or designed to be used in whole or in part for any industry, trade, manufacture or commercial purposes or for other than one or more of the following specified purposes . (a) A single detached one family private dwelling. (b) Any use permitted in Residence "A". 2. Building Site Area Required Same as Residence "AA" . 3. Front Yard Required Same as Residence "A". 4. Side Yard Required Same as Residence "A". 5. Rear Yard Required Same as Residence "A" . 6. Building Height Same as Residence "A" . Ordinance No. 90-60-8 Page 2 7 . Minimum Lot Coverage (a) One Story - 950 Square feet living area enclosed coverage. (b) 11 and 2 story - 750 square feet enclosed coverage on ground floor. 8. Accessory Buildings Accessory buildings permitted. SECTION 3. Residence "A-C" District 1. Uses. Within any Residence "A-C" District, as indicated on the Zoning Map, no building or premises shall be used and no building or structure shall be erected which is intended or designed to be used in whole or in part for any industry, trade or any manufacture or commercial purpose, or for other than one or more of the following specified purposes: (a) Any use permitted in Residence "A". (b) Any use permitted in Residence "B". (c) Any use permitted in Residence "C" . 2. Building Site Area Required Same as Residence "A". 3. Front Yard Required Same as Residence "A". 4. Side Yard Required Same as Residence "A". 5. Rear Yard Required Same as Residence "A". 6. Building Height Same as Residence "A". 7 . Minimum Lot Coverage Same as Residence "C". 8. Accessory Buildings Accessory buildings will be permitted SECTION 4. Business "AA" District gyp, 1. Uses. Within any Business "AA" District, no building or premises shall be erected, used, arranged or designed to be used in • Ordinance No. 90-60-8 Page 3 whole or in part for other than one or more of the following or similar specified purposes constructed in the form of a complex creating a shopping center: (a) Retail Stores (d) Offices (b) Theatres (e) Filling Stations (c) Restaurants 2. Uses Prohibited. The following uses shall not be permitted within Business "AA" District. (a) All industrial or manufacturing uses. (b) Any residential use on the ground or first floor except where such use is incident to the permitted business use. (c) In filling stations, no vehicle repair work, except emergency work, shall be done out of doors and no parts, vehicle c bodies or junk shall be stored out of doors. V\p 3. Building Limits No building set back limits from property lines are aC required, but it is intended that a common paved parking area of adequate size shall be provided in front of the several business ' and that access shall be provided to the rear of all units for service facilities. SECTION 5. Commission Approval All plans and specifications for structures in all Business districts shall be submitted to the City Commission by the Building Official for approval as to structure and use. No building permit shall be issued until said approval is obtained. SECTION 6. All ordinances and parts of ordinances in conflict here- with are hereby repealed. SECTION 7 . This ordinance shall become effective immediately upon final passage. Passed by the City Commission on first reading on June 13, 1960.
