AN ORDINANCE TO AMEND ORDINANCE NO. 90-59-3 BEING "AN
ORDINANCE PROVIDING FOR THE ZONING OF THE CITY OF ATLANTIC
BEACH, DUVAL COUNTY, FLORIDA FOR THE PURPOSE OF PROMOTING
HEALTH, SAFETY, MORALS AND THE GENERAL WELFARE OF THE CITY,
UNDER AND PURSUANT TO THE 'ATLANTIC BEACH CHARTER : PROVIDING
FOR THE ENFORCEMENT THEREOF, FIXING PENALTY FOR VIOLATION
THEREOF: REPEALING ORDINANCE NUMBER 50 AND ALL ORDINANCES
IN CONFLICT THEREWITH AND FIXING THE DATE WHEN SAME SHALL
BECOME EFFECTIVE. "
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH,
FLORIDA.
SECTION 1. That Section V, 5, (a) of Ordinance No. 90-59-3
be and the same is hereby amended as follows:
(a) There shall be a rear yard having an area of 1500
square feet, bounded by the side property lines , the rear
property line and a line parallel to the rear property line
)4r*' passing thru the rear most extremity of the main building but
m in no case shall the main building be closer than 20 feet to
41/ 54 the rear property line. In case of a lot having less than
v 100 feet depth at the time of the passage of said Ordinance
' No. 50 the area of the rear yard may be reduced by 1.666% for
m v each foot of the depth of the lot under 100 feet but in no case
, m, shall the main building be closer than 15 feet to the rear

oSECTION 2. All ordinances and parts of ordinances in conflict
m herewith are hereby repealed.

-4 SECTION 3 . This ordinance shall become effective immediately
cupon final passage.
