AN ORDINANCE TO AMEND ORDINANCE N0.90-
59-3 BEING "AN ORDINANCE PROVIDING FOR
THE ZONING OF THE CITY OF ATLANTIC BEACH,
DUVAL COUNTY, FLORIDA FOR THE PURPOSE OF
PROMOTING HEALTH, SAFETY, MORALS AND THE
GENERAL- WELFARE OF THE CITY, UNDER AND
PURSUANT TO THE 'ATLANTIC BEACH CHARTER :
PROVIDING FOR THE ENFORCEMENT THEREOF,
FIXING PENALTY FOR VIOLATION THEREOF:
REPEALING ORDINANCE NUMBER 50 AND ALL
ORDINANCES IN CONFLICT THEREWITH AND FIX-
ING THE DATE WHEN SAME SHALL BECOME EFFEC-
TIVE . "
BE IT ENACTED BY THE PROPLE OF THE CITY OF ATLANTIC BEACH,
FLORIDA.
Section 1. That Section III, Paragraph 5 be amended to
read as follows:
5. Fences and Walls: In the area between the
front property line and the front building set back line
no fence or wall, except retaining walls, shall exceed
four (4) feet in height.
In the area between the
front building set back line and the rear property line no
fence or wall, except retaining walls, shall exceed six (6)
feet in height.
Section II. Notwithstanding any provision hereof, no fence
shall_ be constructed contrary to the provisions of Para-
graph 14, Section III of Ordinance No. 90-59-3.
Section III. That this ordinance shall become effective
immediately upon its passage on final reading.

14, 1961.
Passed by the City Commission on the second and final read-
ing on September 11, 1961.
