59-3, NO. 90-60-8 AND NO. 90-61-11 BEING
"AN ORDINANCE PROVIDING FOR THE ZONING OF
THE CITY OF ATLANTIC BEACH, DUVAL COUNTY,
FLORIDA FOR THE PURPOSE OF PROMOTING
HEALTH, SAFETY, MORALS AND THE GENERAL
WELFARE OF THE CITY, UNDER AND PURSUANT
TO THE 'ATLANTIC BEACH CHARTER : PRO-
VIDING FOR THE ENFORCEMENT THEREOF, FIX-
ING PENALTY FOR VIOLATION THEREOF: RE-
PEALING ORDINANCE NUMBER 50 AND ALL
ORDINANCES IN CONFLICT THEREWITH AND
FIXING THE DATE WHEN SAME SHALL BECOME
EFFECTIVE. "
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH,
FLORIDA.
SECTION I. That Ordinance No. 90-59-3, Section I. "Districts
designated, " Paragraph 1 be amended to read as follows:
1. The City of Atlantic Beach is hereby zoned and divided
into eleven (11) districts as follows:
Residence "AA" (RAA)
Residence "Al" (RA1)
Residence "A" (RA)
Residence "AC" (RAC)
Residence "B" (RB)
Residence "C" (RC)
Residence "D" (RD)
Business "AA" (BAA)
Business "A" (BA)
Business "B" (BB)
Industrial "A" (IA)
SECTION II . That Ordinance No. 90-60-8, Section 4, Business
"AA" District be amended to read as follows:
Section 4. Business "AA"
1. Uses. Within any Business "AA" District, no building
or premises shall be erected, used, arranged or designated to
be used in whole or in part for other than one or more of the
410 following or similar specified purposes constructed in the
form of a complex creating a shopping center:

(a) Retail Stores (c) Restaurants
(b) Theatres (d) Offices
2. Uses Prohibited. The following uses shall not be
permitted within Business "AA" District.
(a) All industrial or manufacturing uses.
(b) Any residential uses on the ground or
first floor, except where such use is
incident to the permitted business use.
(c) Gasoline service stations.
(d) In nonconforming gasoline service sta-
tions, no vehicle repair work, except
emergency work, shall be done out of
doors and no parts, vehicle bodies or
junk shall be stored out of doors.
3. Building Limits. No building set back limits from
property lines are required, but it is intended that a common
paved parking area of adequate size shall be provided in front
of the several businesses and that access shall be provided to
the rear of all units for service facilities.
SECTION III . That Ordinance No. 90-59-3 Section IX Business
°A° District be amended to read as follows:
Section 4. Business "A" District
1. Uses. Within any Business "A" District, no building
or premises shall be erected, used,arranged or designed be
be used in whole or in part for other than one or more of the
following specified purposes:
(a) Retail Stores
(b) Hotels and Motels
(c) Theatres
(d) Restaurants, offices, ice delivery stations,
laundries, shops for making articles sold at retail on the pre-
mises, and for any other similar enterprise, not a nuisance,
the chief characteristic of which is a service to the neighbor-
hood.
2. Uses Prohibited: The following uses shall not be per-
mitted within Business "A" District:
(a) Amusement park or circus
(b) Gasoline Service Stations
(c) Vehicle Repair Garage
(d) Junk Yards

(e) Animal Hospitals
(f) Open air fruit or vegetable stands
(g) Trailer Parks
(h) Outside storage of stock supplies or
equipment
(i) Any residential use on the ground or
first floor except where such use is
incident to the permitted business use.
(j ) In nonconforming gasoline service sta-
tions vehicle garages, no vehicle re-
pair work, except emergency work, shall
be done out of doors and no parts, ve-
hicle bodies or junk shall be stored
out of doors.
3. FRONT YARD: None required
4. SIDE YARD: None required
5. REAR YARD: None required
6. OFF-STREET PARKING: Off-street parking shall be pro-
vided as set out in Section III - 8 of Ordinance No. 90-59-3.
SECTION IV. That Ordinance No. 90-59-3 Section X Business "B"
District be amended to read as follows:
Section 10. Business "B" District.
1. Uses: Within any Business "B" District, no building
or premises shall be erected,used, arranged or designed to be
used in whole or in part for other than one or more of the
following specified purposes:
(a) All uses permitted in Residence"A",
"B", "C" Districts.
(b) All uses permitted in Business "A" •
District.
(c) Trailer or Mobile Home Park, Gasoline Ser-
vice Station, Vehicle Repair, garage, amusement park, circus;
wholesale or storage of food, fodder, fuel, building material,
cotton, wool, paper, furniture, hardware, ice, metal, machinery,
paint and similar uses; produce market, steam laundry, cold
storage plant, creamery, printing shop, wholesale baker, con-
tractor 's yard and other enterprises of similar. character not
injurious to neighboring property.
2. Uses Prohibited: The following uses shall not be per-
mitted within Business "B" District.
(a) Junk Yards
(b) Manufacturing uses.

3. FRONT YARD: Business, None Required
Residential, Same as Residence "A"
4. SIDE YARD: Business, None required
Residential, Same as Residence "A"
5. REAR YARD: Business, None required
Residential, Same as Residence "A"
6. OFF-STREET PARKING: Off-street parking shall be pro-
vided as set out in Section III - 8 of Ordinance No. 90-59-3.
SECTION V. That Ordinance No. 90-61-11 Section 3 "Commission
Approval" be amended to read as follows:
Section 15. 4 Commission Approval: All plans and
specifications for structures in all Business and Industrial
districts shall be submitted to the City Commission by the
Building Official for approval as to structure, use and struc-
ture location on plot.
All plans and specifications for struc-
tures in Business "AA" and Business "A" Districts proposed to
be constructed as a shopping center complex, consisting of
several stores, etc. together with a common parking area shall
be submitted with complete over-all plans showing lay out of
all buildings, parking and service facilities, front elevation
of proposed project, drainage, paving, curb and guttering and
utilities plans.
No building permit shall be issued in any
business or industrial district until said approval is obtained.
SECTION VI . That this ordinance shall become effective imme-
diately upon its passage on final reading.
