AN ORDINANCE AMENDING ORDINANCE NO. 90-59-3,
BEING AN ORDINANCE ENTITLED: "AN ORDINANCE
PROVIDING FOR THE ZONING OF THE CITY OF
ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, FOR
THE PURPOSE OF PROMOTING HEALTH, SAFETY,
MORALS AND THE GENERAL WELFARE OF THE CITY,
UNDER AND PURSUANT TO THE 'ATLANTIC BEACH
CHARTER ; PROVIDING FOR THE ENFORCEMENT
THEREOF; REPEALING ORDINANCE NUMBER 50 AND
ALL ORDINANCES IN CONFLICT THEREWITH AND
FIXING THE DATE WHEN SAME SHALL BECOME
EFFECTIVE"
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH,
FLORIDA:
SECTION L. Ordinance No. 90-59-3, commonly known as
the Zoning Ordinance, be and the same is hereby amended by
adding at the end of Section I thereof the following:
"In addition to the districts created, established
and designated by Section I of Ordinance No. 90-59-3,
there is hereby created and establis hL.d an
additional district to be known and ..asignated as
'Business A-1 ' (BA-1) , the boundaries of which
said district are hereby fixed and established as
follows, and the zoning map adopted by said Ordi-
nance 90-59-3 is hereby amended and changed accord-
ingly:

For a point of reference commence at the Northwest
corner of Club Manor, according to plat thereof
recorded in Plat Book 25, page 62 of the current
public records of Duval County, Florida; run
thence North 85° 32 ' 15 " East along the North
line of said C',ub Manor, a distance of 581.61
feet to the Easterly line of said Club Manor; run
thence North 4° 12 ' 55 " West in the Easterly line
of Club Manor projected Northerly 30 feet to the
point of beginning; from the said point of
beginning continue North 4° 12 ' 55" West in the
Easterly line of Club Manor projected Northerly
661. 30 feet to the South line of Tenth Street;
run thence South 83° 40 ' 45 " West in the Southerly
line of Tenth Street 285.30 feet; run thence South
40 29 ' 15 " East 582.06 feet; run thence North

85° 32 ' 15 " East 94. 58 feet; run thence South
4° 27 ' 45 " East 100 feet; run thence North
85° 32 ' 15 " East 30 feet; run thence North

beginning.
SECTION II . BUSINESS A-1 DISTRICT
1 . Uses . Within any Business A-1 District no building
or premises shall be erected, used, arranged or designed to
be used, in whole or in part, for other than one or more of
the following specified purposes:
(a) Any uses specified in Sections IV, V, VI
and VII of said Ordinance No. 90-59-3;
(b) Hotels and Motels
(c) Restaurants (except drive-in restaurants)
cocktail lounges, barber shops, beauty parlors,
retail stores , and similar businesses operated in
conjunction with and within a hotel or motel.
2 . Uses Prohibited. The following uses shall be pro-
hibited within Business A-1 District:
(a) Filling Stations
(b) Ice Delivery Stations
(c) Laundries
(d) Amusement Park or Circus
(e) Vehicle Repair Garage
(f) Junk Yards
(g) Animal Hospitals
(h) Open air fruit or vegetable stands
(i) Trailer Parks
3 . Cff-street Parking. Off-street Parking shall be
provided as set out in Section III-8 of Ordiance No. 90-59-3 .

4. Building Restriction Line. No structure shall be
erected nearer than 71 feet to the East 157 .65 feet of the
South line of the land described in Section 1 hereof.
5. This Ordinance shall take effect immediately upon
its final passage.
