AN ORDINANCE TO AMEND ORDINANCE NO. 90-59-3
BEING "AN ORDINANCE FOR THE ZONING OF THE CITY
OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, FOR
THE PURPOSE OF PROMOTING HEALTH, SAFETY, MORALS
AND THE GENERAL WELFARE OF THE CITY, UNDER AND
PURSUANT TO THE ATLANTIC BEACH CHARTER: PROVIDING
FOR THE ENFORCEMENT THEREOF, FIXING PENALTY FOR
VIOLATION THEREOF: REPEALING ORDINANCE NUMBER 50
AND ALL ORDINANCES IN CONFLICT THEREWITH AND FIX-
ING THE DATE WHEN SAME SHALL BECOME EFFECTIVE " .
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH,
FLORIDA:
Section I . That paragraph 6 of Section VII Residence "C "
District be, and is hereby amended by doletion' of entire
paragraph and substitution of new paragraph as follows:
6. BUILDING HEIGHT.
"No building or structure shall be erected
to a height in excess of 30 feet except in
the case of a Church, Library, Municipal or
Institutional Building; no part of any such
building shall be erected in excess of a
height of 60 feet; flag poles, radio towers
and church spires are excepted from this
provision. In buildings having an over-all
height of 30 feet or less, the minimum dis-
tance between finished floor surface and
ceiling shall be not less than 8 feet; this
provision being applicable to each and every
story, or living space, in such structure".
Section II . That this Ordinance shall become effective imme-
diately upon its passage on final reading.
