AN ORDINANCE TO AMEND ORDINANCE NO. 90-59-3 BEING "AN"
ORDINANCE PROVIDING FOR THE ZONING OF THE CITY OF ATLANTIC
BEACH, DUVAL COUNTY, FLORIDA, FOR THE PURPOSE OF PROMOTING
HEALTH, SAFETY, MORALS AND THE GENERAL WELFARE OF THE CITY,
UNDER AND PURSUANT TO THE 'ATLANTIC BEACH CHARTER' : PRO-
VIDING FOR THE ENFORCEMENT THEREOF, FIXING PENALTY FOR
VIOLATION THEREOF: REPEALING ORDINANCE NUMBER 50 AND ALL
ORDINANCES IN CONFLICT THEREWITH AND FIXING THE DATE WHEN
SAME SHALL BECOME EFFECTIVE" .
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA.
SECTION I. That Section III, Paragraph 5 be amended to read as
follows:
5. Fences and Walls: In the area between the front
property line and the front building set back line
no fence or wall shall exceed four (4) feet in
height.
In the area between the front building set back line
and the rear property line no fence or wall shall
exceed six (6) feet in height.
No person shall construct, erect or place on any
property within the City any seawall or retaining
wall, without first obtaining a permit therefor
from the City and submitting adequate plans and
specifications to show the building official of
the City the construction contemplated. For the
purpose of this section, a seawall or retaining
wall is defined to be any wall used to resist the
lateral displacement of any material.
SECTION II. Notwithstanding any provision hereof, no fence shall be
constructed contrary to the provisions of Paragraph 14, Section III
of Ordinance No. 90-59-3.
SECTION III. Ordinance 90-61-12 and all ordinances or parts of ordi-
nances in conflict herewith are hereby repealed.
SECTION IV. That this Ordinance shall become effective immediately
upon its passage on final reading.
