Ordinance No. 90-85-84 v ORDINANCE NO. 90-85-84 AN ORDINANCE ZONING PROPERTY HEREIN DESCRIBED OWNED BY MARY T. BULL AND OPTION BY REYHANI, INC. , IN VENTURE WITH PHIL GRENVILLE AND DON MEUSE, TO "PUD"DISTRICT AS DEFINED UNDER THE LAND DEVELOPMENT CODE, AND PROVIDING AN EFFECTIVE DATE WHEREAS, Mary T. Bull, the owner of certain property herein described, and Reyhani, Inc. , Phil Grenville and Don Meuse, who have optioned to purchase said property, have applied to the City Commission to zone said property "PUD" in accordance with the Land Development Code, and WHEREAS, the Advisory Planning Board met on December 4, 1984, to consider the "PUD" zoning application, and conducted a public hearing, and WHEREAS, the Advisory Planning Board has rendered its recommendation to the City Commission, including special conditions related thereto, said conditions presented to the City Commission on December 10, 1984, also being on file with the City and by reference made a part hereof, and WHEREAS, the City Commission finds that (a) The "PUD" zoning is consistent with the Land Development Code and the Comprehensive Plan adopted by the City, and (b) The "PUD" zoning will not adversely effect the health and safety of the residents in the area and will not be detrimental to the natural environment or to the use or development of the adjacent properties in the general neighborhood. NOW, THEREFORE, be it enacted by the people of the City of Atlantic Beach, Florida Section 1. Property Zoned. The real property described in Section 2 below is hereby zoned "PUD" as defined and classified under the Land Development Code of the City of Atlantic Beach, Florida, in compliance with the application and plans on file with the City, and by reference made a part hereof, and subject to the conditions and recommendations of the Advisory Planning Board to the City Commission, said conditions and recommendations also being on file with the City and by reference made a part hereof. Section 2. Owner and Description. The real property zoned by this ordinance is owned by Mary T. Bull, borders Plaza on the south, 11th Street on the north, Royal Palms Unit 1 on the west, and the lagoon on the east, will contain 170 townhouse units (85 buildings) with a density of 5.76, more or less, units to the acre. The property is located in Atlantic Beach, Duval County, Florida, and is more particularly described as follows: A part of Section 16 and 17, Township 2 South, Range 29 East, Duval County, Florida, and being more particularly described as follows: Begin at the Southwest corner of Lot 1, Block 7, Selva Marina Unit No. 3, Plat Book 29, page 27, of the current Public Records of said County; thence South 83°42'00" West along the Northerly right-of-way line of the Plaza, 1,412.52 feet to the Southeast corner of Lot 1 , Block 6, Royal Palms Unit No. 1 , Plat Book 30, pages 60 and 60A of the current Public Records of said County; thence run North 06°45'00" West along the Easterly line of said Royal Palms Unit No. 1 and its Northerly prolongation thereof, 919.63 feet; thence North 83°42'00" East, 744 .66 feet; thence South 06°18'00" East, 30.0 feet to the Southerly right-of-way line of Eleventh Street; thence along the said Southerly right-of-way line of said Eleventh Street run North 83°42' 00" East, 675.0 feet to the Northwest corner of Lot 8, Block 7 of said Selva Marina Unit No. 3; thence South 06°18'00" East along the Westerly line of said Selva Marina Unit No. 3, 890.0 feet to the point of beginning. Containing 29.47 acres more or less. Section 3. Effective Date.
