AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY
OF ATLANTIC BEACH, FLORIDA; AMENDING THE LAND DEVELOP-
MENT CODE BY AMENDING THE OFFICIAL ZONING MAP TO REZONE
LAND HEREIN DESCRIBED FROM RS-2 AND CG TO RG-3; PRO-
VIDING AN EFFECTIVE DATE.
WHEREAS, the City of Atlantic Beach Advisory Planning Board has
considered a request to change the zoning submitted by Edna L. Johansen
and has conducted a public hearing on same on Tuesday, April 15, 1985,
and
WHEREAS, the Advisory Planning Board did recommend to the City
Commission on April 22, 1985, that the property described herein be
rezoned from Residential Single=Family (RS-2) and Commercial General
(CG) to Residential General 3 (RG-3) , and
WHEREAS, the City Commission does exercise its powers to amend the
Land Development Code, including the official zoning district map, in
order to encourage the most appropriate use of land, and
WHEREAS, the rezoning is consistent with the Atlantic Beach
Comprehensive Plan,
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City
of Atlantyc Beach, Florida, as follows:
Section 1. That the zoning district for the land described
herein Wow and the official zoning map be amended to change the zoning
from Resential Single Family and Commercial General to Residential
General (RG-3) .
The property affected by this rezoning is described as follows:
A part of "Hotel Reservation" according to map of Atlantic
Beach, Florida, as recorded in Plat Book 5, Page 69, together
with Lot 15, Club Manor, according to plat recorded in Plat
Book 25, Page 62, of the Current Public Records of Duval
County, Florida, and more particularly described in the
attached contract for sale and purchase of real property
attached hereto as Exhibit A.

Section 2. This ordinance shall take effect immediately upon
its passage.

CONTRACT FOR SALE AND PURCHASE
OF REAL PROPERTY
THIS CONTRACT FOR SALE AND PURCHASE OF REAL PROPERTY is made
this 1st day of March, 1985 , between EDNA L. JOHANSEN, [hereafter
"Seller"] , and DANIEL T. CRISP, III, [hereafter "Buyer " ] , or his
assigns;
WITNESSETH:
WHEREAS, Seller desires to sell and Buyer desires to
purchase that certain improved real property located, situate and
being in Duval County, Florida, described as follows:
All that portion of the property and premises
designated as "Hotel Reservation", according
to a map of Atlantic Beach, Florida, recorded
in Plat Book 5 , Page 69, of the current
public records of Duval County, Florida, more
particularly described and bound as follows:
Commencing at the point of intersection of
the Northerly projection of the center line
of Beach Avenue with the South boundary line
of said "Hotel Reservation" (said South Line
of "Hotel Reservation " also being the North
line of Seventh Street) , thence run in an
Easterly direction along said South line of
said "Hotel Reservation" a distance of
seventy-six and three tenths (76 .3 ) feet for
a point of beginning; thence continue along
said "Hotel Reservation" South line a
distance of one hundred ninety-five ( 195 )
feet, more or less , to the concrete seawall;
thence run in a Northerly direction along
said seawall a distance of seventy-seven t77 )
feet; thence run in a Westerly direction and
parallel to the South line of said "Hotel
Reservation" a distance of one hundred
ninety-five (195 ) feet, more or less , thence
run in a Southerly direction along a line
parallel to the said concrete seawall a
distance of seventy-seven ( 77 ) feet to the
Point or Place of Beginning. Together with
the land lying between the Easterly boundary
of the described premises and ordinary high
water mark of the Atlantic Ocean and together
with all and singular the riparian and
littoral rights thereunto belonging or in
anyway appertaining.
Also the right of ingress and egress from and
to said Seventh Street over a strip of land
fifty (50 ) feet wide as measured
perpendicular to the Westerly boundary of the
described premises, said strip of land lying
West of and adjacent to the Westerly boundary
• of the described premises.

Lot Fifteen ( 15 ) , Club Manor , according to
plat recorded in Plat Book 25, Page 62 , of
the current public records of Duval County,

between the Easterly boundary of the
described premises and ordinary high water

plat of Atlantic Beach, according to plat
recorded in Plat Book 5, Page 69, of the
current public records of Duval County,
Florida, more particularly described as :
Beginning at the intersection of the South
line of Lot Fifteen (15 ) , Club Manor,
according to plat recorded in Plat Book 25 ,
Page 62, of said public records, with the
concrete bulkhead, said point being the
Southeast corner of said Lot Fifteen (15 ) ;
and running thence South Eighty-three ( 83 )
degrees Forty-two (42 ) minutes West along the
said South line of said Lot Fifteen (15) ; One
Hundred Ninety-five (195) feet to the
Southwest corner of said Lot Fifteen (15 ) ;
running thence South Four (4) degrees Ten
( 10 ) minutes East, Twenty ( 20 ) feet; running
thence North Eighty-three (83 ) degrees,
' Forty-two ( 42 ) minutes East, One Hundred
Ninety-five (195) feet to the said concrete
bulkhead; running thence North Four ( 4)
degrees Ten (10 ) minutes West along the said
concrete bulkhead Twenty ( 20 ) feet to the
point of beginning. Together with the land
lying between the Easterly boundary of the
described premises and ordinary high water
mark of the Atlanitc Ocean and together with
all and singular the riparian and littoral
rights thereunto belonging or in anyway
appertaining.

NOW, THEREFORE, in consideration of the covenants,
conditions and mutual undertakings provided for herein, and for
other good and valuable consideration, the receipt and
sufficiency of which hereby is acknowledged, the Seller agrees to
sell and the Buyer agrees to purchase on the terms hereafter
stated all of the Seller' s right, title and interest in, of and
to the Property, to-wit:
1 . Purchase Price. Subject to the adjustments and
pro-rations hereafter described, the total purchase price to be
paid by the Buyer to the Seller for the purchase of the Property
• is the sum of Five Hundred Twenty-Five Thousand and No/100
Dollars ( $525, 000. 00 ) . The purchase price will be paid in the
following manner:
