AN ORDINANCE AMENDING THE ORDINANCE CODE OF
THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING
CHAPTER 24, ARTICLE III, DIVISION 3, SECTION
24-63, SUB-PARAGRAPH (1) and (2)e TO PROVIDE
APPLICATIONS FOR EXCEPTION SHALL ONLY BE FILED
AND SIGNED BY THE OWNER OF THE PROPERTY OR THEIR
AUTHORIZED AGENT OR ATTORNEY; AMENDING SUB-
PARAGRAPH 2 TO CREATE ITEM f. TO ESTABLISH A
FILING FEE; AMENDING SUB-PARAGRAPH 5 TO PROVIDE
FOR A PUBLIC HEARING AFTER DUE PUBLIC NOTICE;
AMENDING SECTION 24-64 SUB-PARAGRAPH (2) TO
PROVIDE FOR A FILING FEE; PROVIDING AN EFFECTIVE
DATE
BE IT ORDAINED by the City Commission of the City of Atlantic
Beach, Florida:
Section 1 . Chapter 24, Article III, Division 3, Section 24-63,
sub-paragraphs 1 , 2 and 5 are hereby amended to read as follows:

Division 3. Application Procedures
Section 24-63. Use by Exception
The Following steps are to be followed to request a use by exception:
(1) . All applications shall be filed with the administrative
official on the proper form furnished by the administrative official,
and said application shall only be accepted when filed by the owner of
the property under consideration or his authorized agent or attorney.
(2) . The application submitted shall include the following informa-
tion:
a. An adequate legal description of the premises as to which the
use by exception is requested;
b. The names and addresses of the owners or tenants in possession
of the premises;
c. A description of the use by exception desired, which shall
specifically and particularly describe the type, character and
extent of the proposed use by exception;
d. The reason for requesting the use by exception;
e. The signature of the applisaxt owner or the applieaxt!s
owner's authorized agent or attorney, including a copy of the
agency agreement or written consent of the owner.
f. Payment of the official filing fee as set by the city
commission.
(5) The City Commission shall conduct a public hearing after due
public notice, following which they shall consider the application for
use by exception permit and the planning agency's report and recommenda-
tion thereon, as well as citizens attending such hearing and shall deny,
approve, or approve with conditions the petitions.
Section 2. Chapter 24, Article III, Division 3, Section 24-64,
sub-paragraph 2 is hereby amended to read as follows:

Section 24-64. Variances
(2) An application for any variance shall be submitted, containing
a complete legal description of the premises for which the variance is
requested. The application shall be accompanied by payment of the
official filing fee as set by the City Commission and a survey or plot
diagram indicating setbacks and proposed construction.
Section 3. This Ordinance shall take effect upon its adoption.
