AN ORDINANCE AMENDING THE ORDINANCE CODE OF
THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING
CHAPTER 24, THE COMPREHENSIVE ZONING AND SUB-
DIVISION REGULATIONS OF THE CITY OF ATLANTIC
BEACH; AMENDING SECTION 24-151 SUBPARAGRAPH
(b) SUBPARAGRAPH (3) TO PROVIDE EXCEPTIONS FOR
PRIVATE SWIMMING POOLS; AMENDING SECTION 24-164
SUBPARAGRAPH (2) (b) AND (c) TO PROVIDE SETBACKS
IN REGARDS TO THE CONSTRUCTION OF SWIMMING POOLS;
PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED by the City of Atlantic Beach, Florida, as follows:
Section 1 . Section 24-151 subparagraph (b) and subparagraph (3)
is hereby amended to read as follows:

Division 7 Supplementary Regulations
Section 24-151. Accessory Uses and Structures
(b) Accessory uses by zoning district. The following accessory
uses and structures shall only be permitted in the zoning
districts as enumerated in this article:
(3) In any zoning district:, except as to private swimming pools:
Section 2. Section 24-161 subparagraph (2) , subparagraph (b)
and (c) be amended to read as follows:

Section 24-164. Swimming pools.
No swimming pool or family pool shall be so located, designed,
operated or maintained as to interfere with the rights of the adjoining
properties.
(1) Lights: Lights used to illuminate any swimming pool shall be
so arranged and shadowed as to reflect light away from
adjoining premises.
101, (2) Setbacks: The following setbacks shall be maintained:
(a) Minimum front setback, shall be the same as requirements
for a residence located in the parcel where the pool is
to be constructed, provided, that in no case is the pool
to be located closer to a front line than the main or
principal building is located;

of depth of the swimming pool.
Section 3. This Ordinance shall take effect upon its adoption.
