Ordinance No. 90-86-107 v ORDINANCE NO. 90-86- 107 AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 24, ARTICLE III, DIVISION 7, TO ADD A NEW SECTION 24-171 REGULATING VEHICLE REPAIR AND TOWING OPERATIONS; PROVIDING AN EFFECTIVE DATE BE IT ORDAINED by the City Commission of the City of Atlantic Beach, Florida: Section 1. Chapter 24, Article 3, Division 7 of the Code of the City of Atlantic Beach, Florida, is hereby amended to create Section 24-7, which said section shall read as follows: CHAPTER 24 ZONING AND SUBDIVISION REGULATIONS ARTICLE III ZONING REGULATIONS • DIVISION 7. SUPPLEMENTARY REGULATIONS Section 24-171. Vehicle Repair and Towing Operations (a) Any business engaged in the major repair or towing and storage of automobiles, trucks, buses, trailers, boats, engines, motors, recreational vehicles, farm tractors and machines, and all other motorized and towed vehicles and parts, shall conduct any and all repairs and storage of such vehicles and parts entirely within an enclosed building. When it is impractical to undertake such repairs and/or storage within an enclosed building, the repair, painting and storage of these vehicles and parts, etc. shall be in an area which is screened by an opaque fence, wall, or landscaped buffer at least six (6) feet in height, said fence, wall, or buffer to be main- tained in good condition at all times. (b) Any business engaged in the minor repair or storage of the items referred to in (a) above, and when located adjacent to or within one hundred and fifty (150) feet of a residentially zoned district, must provide an area in which these items may be enclosed or provide an area that is screened from the residential zoning district by an opaque fence, wall, or landscaped buffer at least six (6) feet in height, said fence, wall, or buffer to be maintained in good condition at all times. • (c) For the purposes of subparagraph (a) , "major repair" shall include all such activities as painting or spray painting; repairs to body, fender, bumper, clutch, transmission, differential, axle, spring, or similar parts; overhaul or repair of engine requiring removal of cylinder head or crank case pan; repair of radiator requiring removal from vehicle; recapping and retreading of tires; or similar activities. (d) For the purposes of (b) "minor repair" shall include such activities as engine tune-up; servicing of spark plugs, batteries, distributors and similar items; replacement of mufflers, tail pipes, water hose, fan belts, brake fluid, light bulbs, fuses, floor mats, seat belts, seat covers, windshield wipers and blades, grease retainers, wheel bear- ings, mirrors and similar items; cleaning and flushing of radiators; repair or replacement of fuel pumps and lines; minor servicing or repair of carburetors, minor repairs to electrical systems; minor adjustment of motors not involving removal of head or crank case or racing motors; or similar activities. Section 2.
