AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY
OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 24
ARTICLE III, DIVISION 3, SECTION 24-63, SUBPARAGRAPH
(3) TO PROVIDE FOR A PUBLIC HEARING BEFORE THE
PLANNING AGENCY (COMMUNITY DEVELOPMENT BOARD) ON
APPLICATIONS FOR EXCEPTIONS; PROVIDING AN EFFECTIVE
DATE
BE IT ORDAINED BY THE CITY COMMISSION of the City of Atlantic
Beach, Florida:
Section 1. Chapter 24, Article III, Division 3, Section 24-63
subparagraph (3) is hereby amended to read as follows:

ZONING AND SUBDIVISION REGULATIONS
ARTICLE III. ZONING REGULATIONS
DIVISION 3. APPLICATION PROCEDURES
Section 24-63. Use by Exception
(3) After the administrative official has received the request,
the request will be placed on the agenda of the next meeting of the
planning agency (Community Development Board) which will meet the time
limit required by the planning agency. The planning agency shall study
each request for use by exception, conduct a public hearing after due
public notice, and make a written recommendation to the City Commission.
The written report and recommendation shall state specific reasons and
findings of fact, upon which its recommendation is based.
Section 2. This Ordinance shall take effect upon its adoption.
