Ordinance No. 90-87-126 v ORDINANCE NO. 90-87- 126 AN ORDINANCE OF THE CITY OF ATLANTIC BEACH ACCEPTING AND APPROVING LAND DEVELOPMENT PLAN AND PROPOSAL SUBMITTED BY MR. MICHAEL A. AKEL AND CERTAIN CON- DITIONS FOR DEVELOPMENT OF LAND IN THE CITY OF ATLANTIC BEACH; PROVIDING AN EFFECTIVE DATE WHEREAS, the City Commission has been presented a land development plan and proposal by Michael A. Akel setting forth conditions under which development of the land hereinafter described will constitute an innovative development project; and WHEREAS, the plan and proposal submitted reduces the density permitted under present zoning and subdivision regulations and will reduce the impact on public facilities necessary to serve the project, and WHEREAS, the plan and proposal will reduce the "psychological barrier" to public use of the beach and reduce beach congestion; and WHEREAS, the property described does not meet the requirements in size for a Planned Unit Development, and WHEREAS, the City desires to accept the proposed plan submitted by Mr. Akel for development of the property without amending any of its present land use regulation and does hereby find that the plan will be compatible with the surrounding properties. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS: SECTION 1. Notwithstanding the provision of the Ordinance Code of the City of Atlantic Beach, the plan and proposal for developing proper- ty of Michael A. Akel described in and in accordance with the design quality standards for Seminole Reach and Oceanside, Seminole Road, North Atlantic Beach, prepared by Hilton T. Meadows, ASLA, Diversified En- vironmental Planning dated September 21, 1987 be, and the same is hereby accepted and approved. SECTION 2. Three copies of the plan and proposal described in Section 1 are on file in the office of the City Clerk and are by refer- ence incorporated herein as if set forth verbatim in this Ordinance. The plan and proposal for development shall remain on file and may not be amended or deviated from without prior approval of the City Commis- sion and notice to the property owners of the property described there- in. SECTION 3. The owners of the property agree that prior to applying to the City for any building permit they will record in the public records of Duval County the covenants, conditions and restrictions approved by and submitted to the City for Michael A. Akel, S.G.M.O. Joint Venture I, a copy of which is filed with the City Clerk of Atlantic Beach and shall prepare and submit for approval by the City Commission subdivision plat, and upon such approval, record same in the public records of Duval County. SECTION 4.
