AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY
OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 24,
ARTICLE IV, DIVISION 1 , SECTION 24-188 (c) TO
PROVIDE FOR RECOMBINATION OF LOTS WHERE NO SUCH
RECOMBINED LOT WOULD HAVE LESS THAN FIVE THOUSAND
(5,000) SQUARE FEET AND WHERE THE DENSITY OTHERWISE
PERMITTED WOULD BE REDUCED; PROVIDING AN EFFECTIVE
DATE
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC
BEACH, FLORIDA
Section 1. Chapter 24, Article IV, Division 1, Section
24-188(c) is hereby amended to read as follows:
CHAPTER 24. ZONING AND SUBDIVISION REGULATIONS
ARTICLE IV. SUBDIVISION REGULATIONS
DIVISION 1. GENERALLY
Section 24-188. Resubdivision of land
(c) COMBINATION OR RECOMBINATION OF PREVIOUSLY PLATTED LOTS.
No combination or recombination of portions of previously
platted lots is permitted when new parcels or residual parcels
smaller than any of the original lots are created, unless
otherwise permitted under townhouse regulations, or, except on
approval of the City Commission, when the recombination of
lots will reduce density otherwise permitted and further
provided that the square footage of any such recombined lot
shall not be less than five thousand (5,000) square feet.
Section 2. This Ordinance shall take effect upon its adoption.
