ORDINANCE NO. 90-88-136
AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY
OF ATLANTIC BEACH, FLORIDA; AMENDING CHAPTER 24,
ARTICLE IV, DIVISION I, SECTION 24-188(c) TO PROVIDE
FOR THE COMBINATION OR RECOMBINATION OF PREVIOUSLY
PLATTED LOTS UNDER CERTAIN CONDITIONS; PROVIDING AN
EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH,
FLORIDA
Section 1. Chapter 14, Article IV, Division 1, Section 188(c) is
hereby amended to read as follows:

ZONING AND SUBDIVISION REGULATIONS
ARTICLE IV. SUBDIVISION REGULATIONS
DIVISION 1. GENERALLY
Section 24-188. Resubdivision of land
(c) Combination or recombination of previously platted lots.
No combination or recombination of portions of previously platted lots is
permitted when new parcels or residual parcels smaller than any of the
original lots created, unless otherwise permitted under townhouse
regulations, or, except on approval of the City Commission, when the
recombination of lots will reduce density otherwise permitted and further
provided that the square footage of any such recombined lot shall not be
less than five thousand (5,000) square feet. Upon approval of the City
commission lots which fall under the definition of double frontage lots,
except lots having frontage on the Atlantic Ocean, may be combined or
recombined where residual parcels smaller than any of the original lots
are created provided that after such division is accomplished, the
residual lots can meet the required lot area, lot width, and all required
front, rear, and side yard setbacks.
Section 2. This Ordinance shall take effect upon its adoption.
