ORDINANCE NO 90-89-142 -
AN ORDINANCE AMENDING THE ORDINANCE CODE
OF THE CITY OF ATLANTIC BEACH, FLORIDA;
AMENDING CHAPTER 24, ARTICLE III,
DIVISION 6, SECTION 24-129, PLANNED UNIT
DEVELOPMENT (PUD) ; BY PROVIDING EXCEPTION
TO THE SITE REQUIREMENT; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, FLORIDA
Section 1. Chapter 24, Article III, Division 6, Section 24-129
is hereby amended to read as follows:
CHAPTER 24
ZONING AND SUBDIVISION REGULATIONS
ARTICLE III, ZONING AND SUBDIVISION REGULATIONS
DIVISION 6, PLANNED UNIT DEVELOPMENT (PUD)
Sec. 24-129. Permitted uses and site requirements.
(a) Permitted uses. Any use which is permitted or permissible
by exception in any district may be included in a planned unit
development.
(b) Site requirements. Minimum site area required in a planned
unit development is seven (7) acres.
(c) Exception to site requirements. In order to promote
development in a sensitive and quality controlled manner at lower
density levels, the City Commission may grant exception to the
minimum site requirements when the developer can demonstrate that
the density will be reduced substantially from that allowed under
the current zoning of the property. The application for exception
to the site requirements of a planned unit development shall include
written design quality standards which address the following:
1 ) building and occupancy types;
2) height of all structures;
3) building materials;
4) landscaping and vegetation preservation;
5) lot coverage and yard requirements;
6) grading, filling and drainage;
7) utilities;
8) traffic circulation and public safety;
9) establishment of an Architectural Review Committee.
When exception to the site requirements of the planned unit
development is approved, such approval will be designated on the
zoning atlas as Contract Quality Development (COD) .
Section 2. This ordinance shall take effect upon its adoption.
