ORDINANCE NO. 90-89-145
AN ORDINANCE AMENDING THE ORDINANCE CODE OF
THE CITY OF ATLANTIC BEACH, FLORIDA;
AMENDING CHAPTER 24, THE COMPREHENSIVE
ZONING ORDINANCE AND LAND DEVELOPMENT CODE
BY AMENDING THE OFFICIAL ZONING MAP TO
REZONE LAND OWNED BY SAMUEL W. WATERS
DESCRIBED AS LOT 5, BLOCK 3, LEWIS SUBDI-
VISION FROM RESIDENTIAL GENERAL RG-1 TO
RESIDENTIAL GENERAL RG2; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, The Community Development Board of the City of
Atlantic Beach has considered a request to change a zoning
classification submitted by Samuel W. Waters, and held a public
hearing on same on June 20, 1989, and
WHEREAS, The City Commission does exercise its powers to
amend the Comprehensive Zoning Ordinance and Land Development
Code, including the Official Zoning Map, in order to encourage
the appropriate use of land, and
WHEREAS, the rezoning will not adversely effect the health
and safety of the residents of the area, and will not be detri-
mental to the natural environment or to the use or development of
the adjacent properties in the general neighborhood,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF ATLANTIC BEACH, FLORIDA:
Section 1. The Official Zoning Map of the City of Atlantic
Beach is hereby changed to reflect the new zoning of property
described as Lot 5, Block 3, Lewis Subdivision from Residential
General RG-1 to Residential General RG-2.
Section 2. This ordinance shall become effective
immediately upon its adoption.

Dear Ms. King:
Pursuant to our telephone conversation of this date, please abate
the public hearing on my client, Sam Waters' rezoning petition
now scheduled to be before the Commission on Monday, August 14,
1989 . As you know, Mr. Waters is pursuing a replat of the same
property and until we have exhausted that avenue, we see no
reason to take up the Commission' s time with our request for a
rezoning.
