Mayor Ford explained the process for public comments and opened the Courtesy of the Floor
to Visitors.
PUBLIC COMMENT
CC Bartle called each speaker to the podium.
Pat Hazouri expressed concerns about the water supply to the 500 Atlantic Blvd
property.
David Bew thanked the Thames brothers and expressed concerns regarding the
Lifeguard Station.
Dylan Beaver expressed concerns about communicating with City staff and requested
that the Commission listen to and respond to the citizens.
Lenny Jevic honored those mentioned in Resolution No. 23-12.
Zann Thames Williams thanked the Commission for considering Resolution No. 23-
12.
Nancy Whittington expressed concerns about the timing of agenda Item 4B and
suggested having a plan for collecting more specific data that can be analyzed.
Larry Mays extended his support for Resolution No. 23-12.
Fred Henderson thanked the Commission for their recognition in Resolution No. 23-
12.

Seth Dalton thanked the Commission for improving the parking at 18th and 19th
Streets and asked that more time be given when reviewing changes.
Jim Wheatley spoke about a previous Beaches Watch meeting. He expressed concerns
about AB development.

3.D.Additional Updates
CM Gerrity explained he has budgeting questions and reported there are some projects
that may not get done unless they get moving on them.
$200,000 Budgeted for a mural at the intersection of Mayport Road
Commissioner Bole spoke in support of the project.
Commissioner Waters expressed that he would like to know what it is and how
much it would cost. CM Gerrity explained that we won't know what it is until
the results of the RFP are received.
Commissioner Kelly mentioned that she's concerned about what will be
depicted in the picture. CM Gerrity reported that it would be brought to the
Commission before awarding an RFP.
Commissioner Ring spoke in favor of the project, based on the conversations
she had with the previous city manager.
Mayor Ford expressed worry about spending $200,000 on a mural, but is open-
minded to the project.
There was a CONSENSUS to allow CM Gerrity to put out an RFP for this project.

project and Mr. Gerrity reported suggestions.
Cultural Arts and Recreation van - CM Gerrity suggested moving $40,000 from this
to an excess fund since the department is not able to find a van at this time.
Mr. Gerrrity also reported the following:
$250,000 was designated for the Selva Marina project.
Recommended increasing the Paving budget (from $325,000) to $400,000.
$7,000 for a road evaluation.
Would like to replace the carpet in City Hall.
There is $250,000 to put back in the bank or designate to another project.
Commissioner Ring advocated for the Arts and Recreation Department in mentioning
that two vans are needed for transporting the kids. CM Gerrity explained the current
challenges with finding a van and they may need to re-budget it for next year.
PWD Williams spoke to the increased cost for paving and suggested putting the
designated six streets out to bid before making a decision on increasing the budget for
that project. Staff answered questions from the Commission.
There was a CONSENSUS to put out the paving bid for the six streets.
3.B.Lifeguard Station Update
PC Gualillo showed a PowerPoint (which is attached hereto and made a part of this
Official Record as Attachment A) and answered questions from the Commission
along with CE Swann.

CE Swann presented this item as detailed in the agenda packet and answered questions
from the Commission.
There was CONSENSUS to allow CM Gerrity to go ahead and purchase at least one
appraisal.
4.REPORTS AND/OR REQUESTS FROM CITY COMMISSIONERS
4.A.Franchised Container Service Providers (Commissioner Waters)
Commissioner Waters briefly reported on this item along with PWD Williams and
answered questions from the Commission. PWD Williams explained why he believes
the franchises have been good for the Public Works Department and that he would
rather have the franchise. Mayor Ford commented on whether there is a need and
noted examples of other cities that do not have a franchise ordinance.

4.B.18th-19th Street Paid Parking (Commissioner Waters)
Commissioner Waters mentioned having spoken with staff regarding this topic since
the last Commission meeting and suggested having Joe Esparza, Parking Enforcement
Officer, work all of AB, fulltime, seven days a week, and potentially having someone
extra during the weekend and filling in during the holiday seasons.
Discussion ensued and suggestions were made to allow time for more data collection
and to let the STOP Committee make recommendations once the Committee is formed.
CM Gerrity explained that the program would need to pay for itself and that the city
will be monitoring it for staffing needs and bring it back to the Commission as needed.

Mentioned that DCM Hogencamp has been working on the Commission priorities,
with water and electricity conservation being one of them. She encouraged everyone to
help get the word out and set the example.

Commented she is thankful for the Thames brothers and Lenny Jevic.
Mentioned that the Easter egg hunt held by the City was a hit.

Mayor Ford reported on the Board Member Review Committee’s recommendations
and provided an overview of the candidates.

regular member (position #1) for the unexpired term ending December 31, 2025; 2) Appoint
Richard Arthur to the Community Development Board to serve as the alternate member
(position #8) for the unexpired term ending December 31, 2023.

CA Gabriel reported on this Resolution. He requested a clarifying amendment to strike
a portion of the third whereas phrase of the easement that reads "or in the event this
Easement (defined below) is terminated in part or in whole, to consider the grant of the
necessary approvals to allow for up to fifty-two (52) units of mobile home density on
the Grantee Property."

Commissioner Bole referred back to previous discussion regarding this Ordinance and
mentioned that he liked the Ordinance due to it benefitting tax payers in some way.
Mayor Ford inquired about flood insurance cost. PCDD Askew explained that flood insurance
cost is a byproduct of a resiliency issue. Mayor Ford expressed that he believes that this is a
resiliency opportunity.
Commissioner Ring referred to a handout that was provided by PCDD Askew (which is
attached hereto and made a part of this Official Record as Attachment C) and mentioned that
this helped with her understanding of the Ordinance. She also mentioned that she would need
more time before approving this Ordinance.
Commissioner Waters inquired about the elimination of the circuit court. PCDD Askew
clarified that this decision was based on the discussion the Commission had on March 13,
2023. Commissioner Ring clarified that the amendments are adding the CDB and striking the
Commission. PCDD Askew answered further questions regarding CDB and recommendations
they would make. CA Gabriel clarified that the changes PCDD Askew is proposing would
make the Commission more of an appellant board and not removing the authority of the
Commission to make a decision; it is placing the Commission as an intervening step before
going to the circuit court.
Mayor Ford expressed concerns relating to the Marsh Front (Zone A) and PCDD Askew
answered questions. Mayor Ford advised that he would be voting against this tonight, but
would like to see it return in a modified form, explaining the need to do an analysis of cost
effect on construction and whether we really have a serious issue. He urged the Commission
to study the issues.
CM Gerrity inquired about a time frame and PCDD Askew expressed that there's no time
frame, but this has not been updated in ten years.

1) The Planning and Community Development Department will facilitate public input meetings
on Land Development Regulations and the Comprehensive Plan at 2 p.m. and 6 p.m.

Regarding:Height limitations of non-habitable structure within the Atlantic Beach Country
Club Planned Development (PUD)/Special Planned Area (SPA)
I.Background.
The City of Atlantic Beach (COAB)has been approached by the Atlantic Beach Country Club
(ABCC)about placing a 35 foot high net on its property located at 0 Maritime Oaks Drive,1600,
1660 Selva Marina Drive,Atlantic Beach,Florida 32233 (ABCC Property)to protect the
neighboring properties adjacent to its driving range located at 1321,1325,1329,1333,and 1337
Estrela Lane,Atlantic Beach,Florida 32233,respectively from errant golf balls.COAB approved
the PUD/SPA on July 8,2013 via Ordinance 90-13-216 (Application No.REZ-13-00100057)
which governs the development standards of the ABCC Property.Section III(C)of the Written
Narrative of the Planned Development cites “none”for maximum heights of structures on the Golf
Course.Section 59 of the COAB Charter (as well as Sections 24-81 and 24-156 Ordinance Code)
contains a thirty-five (35)foot height limit for any buildings within the City.ABCC desires to
place the 35 foot high net on an existing man-made berm which is approximately eight (8)feet in
height.
II.Question Asked.
What height limit applies to golf ball net structures within the PUD /SPA,and in particular,within
the areas of the ABCC Property designated as Golf Course,and how is height measured therein?
III.Short Answer.
When the rules provide for two (2)seemingly different sets of regulations,statutory construction
separate parts being interpreted within their broader statutory context.Therefore in applying thatconcepthere,the rules of the PUD /SPA must be read in harmony with the COAB Charter andOrdinanceCodeandassuchtheCity’s thirty-five (3 5)foot height restriction would apply to anystructuresontheABCCProperty,measured from the highest established grade on the Golf Course(within the vicinity of the proposed structure)as the beginning point of measurement.50765412 V2 Agenda Item #3.B.08 May 2023Page 27 of 68
IV.Discussion.
Section 24-17,Ordinance Code de?nes a “Building”as a structure designed or built for
support,enclosure,shelter or protection ofpersons,animals or property ofany kind.Building shall
include any structure constructed or used for a residence,business,industry or other private or
public purpose,including buildings that are accessory to such uses,provided such buildings are in
compliance with the Florida Building Code."Building"or "structure"includes parts thereof and
these terms may be used interchangeably.
Section 24-17,Ordinance Code further de?nes “Height”as the vertical distance from the
applicable beginning point of measurement to the highest point of a building's roof structure or
parapet,and any attachment thereto,exclusive of chimneys.
Section 24-81,Ordinance Code contains the methods by which the City measures height.In
particular,Subsection (m)sets forth the calculated average grade and Subsection (n)sets forth how
to calculate the height of buildings.
Subsection (n)essentially lays out four (4)different ways to calculate the height of a building,
depending on circumstances which range from parcels that are within a flood hazard area,parcels
not in a flood zone that have a topographic variation of less than two (2)feet,parcels regardless of
flood zone with topographic variation of more than two (2)feet and single story construction.
Because:(a)the subject property where the golf ball net structure is intended to be installed
is a golf course with,by de?nition,varying degrees of undulating topography and other non-
standard grading,and (b)the PUD /SPA expressly states that it contains no height restriction for
structures on the course,in order to apply the principle that a rule be read as a harmonious whole
whenever reasonable,with separate parts being interpreted within their broader statutory context,
to apply the COAB thirty-?ve (35)foot height limit to the ABCC Property it should be measured
by virtue of the most charitable method available in City Code which would dictate that it would
apply to any structures on the Golf Course within the ABCC Property,measured from the highest
established grade on the Golf Course (within the vicinity of the proposed structure)as the
beginning point of measurement.
V.Conclusion.
I trust that this opinion provides the guidance you seek.Please note that the analysis herein is
specific to the ABCC PUD/SPA (and more particularly the Golf Course within the ABCC
Property)due to the unique regulations,annexation history and governing documents related to it.

BACKGROUND:The Elevated Tank at WTP #2 was inspected in 2020,and the ?ndings were
sent to staff in a detailed report.Staff requested bids for the work,and a Bid Opening was held on April
19,2023 for Bid 2223-04:Water Treatment Plant #2 Elevated Storage Tank Repairs.The project consists
of furnishing all labor,materials and equipment necessary for repairs to the exterior of the 300,000 gallon
elevated storage tank at Water Treatment Plant No.2,located at 2301 Mayport Road,Atlantic Beach.
Florida,to include:installing new aluminum ladder gate &removing ladder cage;replacing 18 riser rods;
repair and replace catwalk steel;repair handrail and install 6 angle brackets;cleaning and painting exterior
dome,wind rods and needed areas;grind and paint ladder and ?ow pipe;remove bands for antenna coax
and replace with magnet mounts.

On November 2020,an inspection was conducted on the 300,000 gallon elevated
water storage tank at Water Treatment Plant #2,at 2301 Mayport Road.The
purpose of the assessment was to determine the condition of the structure,and
to evaluate the tank for compliance with current sanitation,safety and security
guidelines.
Recommendations from the inspection were as follows:

The City accounts for its solid waste operations in an enterprise fund.this include

A RESOLUTION OF THE CITY OF ATLANTIC BEACH,FLORIDA
APPROVING A NEW SCHEDULE OF GARBAGE RATES IN
ACCORDANCE WITH THE CITY’S AGREEMENT WITH GFL
ENVIRONMENTAL AND PROVIDING AN EFFECTIVE DATE
WHEREAS,the City of Atlantic Beach’s agreement with GFL Environmental for
solid waste,yard waste and recycling collection and disposal services allows for fuel
rate adjustments based on the On Highway Retail Diesel Price published by the U.S.
Department of Energy and collection rate adjustments based on the U.S.Department of
Labor Consumer Price Index (CPI);and
WHEREAS,GFL Environmental rates have increased their rates according to the
provision of the agreement;and
WHEREAS,the City of Atlantic Beach fees for garbage service must be suf?cient
enough to allow for the continued operation of its Sanitation Fund;and
WHEREAS,the City of Atlantic Beach has not increased its garbage rates since
June of 2019.
NOW,THEREFORE,BE IT RESOLOVED by the City Commission of the City of
Atlantic Beach,Florida,that
1.The new rates re?ect an 18%increase and become effective June 1,2023.
2.This resolution shall take effect immediately upon its passage and
adoption by the City Commission of the City of Atlantic Beach,Florida.

BACKGROUND:This proposed ordinance will adjust the Fiscal Year 2022
/
2023
Annual Budget for the City ot‘Atlantic Beach.A?er six months has passed of the fiscal
year,an analysis is completed to ascertain whether or not adjustments need to be rnade.CityCode
allows for transfers within divisions/departments but not to another division/
department
or
increase the total budgeted amount.To amend the budget,it has to be done in the sarn
e

as
it was adopted,in City oFAtlantic Beach’s case it was done by ordinance.These adj
ust
me
nts
are
in three funds,the General Fund,the Capital Projects Fund and the Police (3f?cers’Fund.
The adjustments within the General Fund are between divisions/departments therefore thereisno
increase to the General Fund budget.
The Capital Projects fund requires a $143,000 increase for an infrastructure account f
o
r
aproject
that was in process in Fiscal Year 2022,but was not cornpleted by year end.During tcourseof
the annual audit ?eldwork,it was discovered that an invoice for a project was though
t
tobelong
in the previous ?scal year actually should have been in the current ?scal year;this r
e
s
u
lt
e
d
ina
timing issue where the remaining project budget did not properly roll~over to the fiscal
year.At the end of Fiscal Year 2022,the amount of $143,000 was deducted from the pr

and
rolled into fund balance.This portion ofthe ordinance brings out that amount of fund ba

and
appropriates back to the project.
There are unforeseen expenditures that take place within the pension funds,whic
h
makesit
difficult to estimate budget amounts.In the case of the Police Of?cer’s Pension lilnd,the
se
items
are DROP payouts and pension refunds.During the past calendar quarter,a pensioner req
ue
ste
d
a
$40,000 distribution from their DROP account which was not included in the budg
et
asitwas
unknown at the time of budget preparation.Additionally,while son-ie pension re

ds
are
anticipated,it is unknown exactly how much is required.This year,$25,000 was but
$37,560 has been paid out so far.This ordinance appropriates a total of $52,560 fror

AN ORDINANCE AMENDING THE OPERATING BUDGET FOR
THE CITY OF ATLANTIC BEACH,FLORIDA FOR FISCAL YEAR
BEGINNING OCTOBER 1,2022 AND ENDING SEPTEMBER 30,
2023,AND PROVIDING AN EFFECTIVE DATE.
WHEREAS,the City Charter of the City of Atlantic Beach requires that the City
Commission approve all budgetary increases and transfers at the ?md level,and
WHEREAS,the nature of budgetary systems and those day-to-day decisions affecting
such budgetary systems require adjustments from time-to-time,and
WHEREAS,the City is amending the operating budget to add net funds totaling $0 in the
General Fund;$143,000 in the Capital Projects Fund;and $52,560 in the Police Of?cers’Pension
Fund for various expenditures.
WHEREAS,the City of Atlantic Beach did not include the funding for these expenditures
in the original adoption of the Fiscal Year 2023 Annual Operating Budget and therefore must
amend the budget to have suf?cient amounts with the General,Capital Projects,and Police
Of?cers’Pension Funds in order fund the expenditures.
NOW,THEREFORE,BE IT ENACTED BY THE CITY COMMISSION ON
BEHALF OF THE PEOPLE OF THE CITY OF ATLANTIC BEACH,FLORIDA that:
