AN ORDINANCE AMENDING THE CODE OF ORDINANCES
OF THE CITY OF ATLANTIC BEACH, AMENDING
CHAPTER 24 , ZONING AND SUBDIVISION REGULATIONS
CHANGING UNDER SEC . 24-17 THE DEFINITIONS OF
"SUBSTANDARD LOT OF RECORD" AND "TOWNHOUSE, "
AMENDING UNDER SEC . 24-83 TO PROVIDE FOR ONLY ONE
SINGLE FAMILY DWELLING ON SUBSTANDARD LOTS
OF RECORD, AND REQUIRING ACTION BY THE
COMMUNITY DEVELOPMENT BOARD, PROVIDING AN
EFFECTIVE DATE .
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, FLORIDA:
Section 1 . The definitions of "substandard lot of
record" and "townhouse" as contained in Sec . 24-17 , Code of
Ordinances , are changed to read as follows :
"Substandard Lot of Record means that the
owner of any such non-conforming lot of
record is permitted to build on such lot,
provided the lot has a width of not less than
fifty ( 50 ) feet and a depth of not less than
one hundred ( 100) feet, with a total lot
area of not less than five thousand ( 5 , 000 )
square feet . A non-conforming lot of record
which do not meet all the above area require-
ments shall not be built on unless relief
is obtained through action of the Community
Development Board and the City Commission.
Any combination of lots resulting in a substandard
lot of record shall be governed hereby. "
"Townhouse shall mean a single-family dwelling
constructed in a series or group of attached
units with property lines separating each
unit . The walls or party wall separating
the dwelling units of the townhouses shall
extend to the roof line of the dwelling
and shall have no openings therein.
Each townhouse unit shall be constructed upon

a separate lot and serviced with separate
utilities and other facilities and shall other-
wise be independent of one another. Each town-
house unit shall be single family dwelling
unit . "
Section 2 . The zoning regulations pertaining to
substandard lots of record, as set forth in Sec . 24-83 , Code of
Ordinances are amended to read as follows :
"Where a lot or parcel of land has an area
or frontage which does not conform with the
requirements of the district in which it is
located, but was a lot of record on July 26 ,
1982 , the lot or parcel of land may be used
for one single-family dwelling in any resi-
dential district, provided the minimum yard
requirements for that residential district
are maintained, and provided that the owner
of said lot has obtained relief through
action of the Community Development Board
and the City Commission. "
Section 3 . This Ordinance shall take effect
immediately upon its final passage and adoption.

14th day of May , 1990 .
PASSED by the City Commission on second and final
reading, this 25th day of June , 1990 .
