AN ORDINANCE AMENDING THE CODE OF
ORDINANCES OF THE CITY OF ATLANTIC
BEACH, AMENDING CHAPTER 24 , ZONING AND
SUBDIVISION REGULATIONS, ADDING UNDER
SEC. 24-82 (B) A HEIGHT RESTRICTION FOR
BUILDINGS OR STRUCTURES ON SUBSTANDARD
LOTS OF RECORD, PROVIDING AN EFFECTIVE
DATE.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF
ATLANTIC BEACH, FLORIDA:
Section 1 . The height restriction on structures and
buildings as contained in Sec. 24-82 (b) , Code of Ordinances , if
amended to read as follows :
" (b) Height. No structures or
building shall be erected, or shall any
existing building be moved,
reconditioned or structurally altered so
as to exceed the height limit specified
in this article for the district in
which such building or structure is
located. However, on substandard lots
of record, the height of any such
structures or buildings shall be
restricted to a percentage of the area
of the substandard lot compared to the
minimum requirements of the zoning
district and applying the same to the
maximum building height allowed in said
zoning district. By way of example, if
in a 5 ,000 square foot minimum lot area
zoning district a building or structure
is proposed on a substandard lot of 2500
square feet, the percentage of 50% would
be applied to the 35 foot height
restrictions , resulting in a net
allowable building height of 17 . 5 feet.
The same restrictions and percentage
calculation shall also apply to mobile
homes , secondary dwellings , and
accessory buildings , provided they are
to be located on a substandard lot of
record.
Section 2 . This Ordinance shall take effect immediately
upon its final passage and adoption.
