AN ORDINANNCE OF THE CITY OF
ATLANTIC BEACH AMENDING THE ZONING
CLASSIFICATION OF PROPERTY KNOWN
AS TRACT B AND TRACT C , CASTRO Y.
FERRER GRANT , FROM RG 2 AND CPO TO
CL ; AMENDING THE OFFICIAL ZONING
MAP TO REFLECT THIS CHANGE ;
PROVIDING FOR SEVERABILITY;
PROVIDING FOR AN EFFECTIVE DATE .
WHEREAS, The Community Development Board of the City of
Atlantic Beach has considered and held a Public Hearing on a
request to change a zoning classification for a certain parcel
of land submitted by the owner , George Helow and ,
WHERAS , The below described parcels will be purchased by
the United States Postal Service for the expressed purpose of
the construction of a new Postal facility , and ,
WHEREAS , The Community Development Board has unanimously
recommended that this request be approved with certain
conditions, and ,
WHEREAS , The rezoning will not adversely effect the health
and safety of the residents of the area, and will not be
detrimental to the natural environment or to the use or
development of the adjacent properties in the general vicinity ,
NOW, THEREFORE , BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF ATLANTIC BEACH , FLORIDA:
SECTION 1 . The Official Zoning Map of the City of Atlantic
Beach is hereby changed to reflect the new zoning of property
described as Tract B and Tract C , Castro Y . Ferrer Grant from
RG-2 , CL and CPO to a uniform
CL , Commercial Light.
This change of Zoning shall be contingent upon the property
being purchased by the United States Postal Service and for the
expressed purpose of the construction of a Postal Facility .
SECTION 2 . Severability . If any section , sentence ,
clause, word , or phrase of this Ordinance is held to be invalid
or unconstitutional by a court of competent jurisdiction , then
said holding shall in no way affect the validity of the
remaining portions of this Ordinance.
SECTION 3 . This Ordinance shall become effective
immediately upon final passage .
