ORDINANCE NO. 90-94- 162
AN ORDINANCE OF THE CITY OF
ATLANTIC BEACH AMENDING THE ZONING
CLASSIFICATION OF PROPERTY KNOWN
AS PART OF LOTS 2 AND 3 , SECTION
16 , AND LOTS 1 AND 5 , SECTION 17 ,
ALSO KNOWN AS RE# 172027-0100 ,
FROM OR, OPEN RURAL TO RS-1
SINGLE FAMILY RESIDENTIAL;
AMENDING THE OFFICIAL ZONING MAP
TO REFLECT THIS CHANGE; PROVIDING
FOR SEVERABILITY; PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, The Community Development Board of the City of
Atlantic Beach has held a Public Hearing on and considered a
request to change a zoning classification for certain parcels
of land submitted by the owners of said parcels, and,
WHEREAS, The below described parcels are proposed for the
purpose of the construction of six Single-family homes , and,
WHEREAS, The City Commission has determined that the
rezoning will not adversely effect the health and safety of the
residents of the area, and will not be detrimental to the
natural environment or to the use or development of the
adjacent properties in the general vicinity, and is in
compliance with the adopted Comprehensive Plan,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF
THE CITY OF ATLANTIC BEACH, FLORIDA:
SECTION 1 . The Zoning Map of the City of Atlantic Beach is
hereby changed to reflect the new zoning of property described
as part of Lots 2 and 3 , Section 16, and part of Lots 1 and 5 ,
Section 17 , also known as RE# 172027-0100, as designated on the
attached map, as RS-1 Single-family Residential .
SECTION 2 . Severability. If any section, sentence,
clause , word, or phrase of this Ordinance is held to be invalid
or unconstitutional by a court of competent jurisdiction, then
said holding shall in no way affect the validity of the
remaining portions of this Ordinance .

SECTION 3 . This Ordinance shall become effective
immediately upon final passage .
