ORDINANCE DESIGNATING THE CITY OF
ATLANTIC BERC}I AS A BIRD SANCTUARY
PROVIDING FOR THE PROTECTION OF BIRDS
AND WILD FOWL; PROVIDING FOR THE ABATE-
MENT OF NUISANCES CAUSED BY BIRDS; AND
PROVIDING FOR PENALTIES FOR THE VIOLATION
THEREOF.
BE IT ELECTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH0 That
Secti€n? 1. That the entire area embraced within the
corporate limits of the City of Atlantic Beach be° and the
same is hereby designated as, a BIRD SANCTUARY.
Section 2. That it shall be unlawful to trap° hunt,
shoot or attempt to shoot or molest in any manner any bird or
wild fowl or to rob bird nests or wild fowl nests. Provided,
however° if starlings or similar birds are found to be congre-
gating in such numbers in a particular locality that they
constitute a nuisance or a menace to health or property in
the opinion of the proper health authorities of the City of
Atlantic Beach° then in such event said health authorities
III shall meet with representatives of the Audubon Society° Bird
Club, Garden Club or lane Society° or as many of said clubs
as are found to exist in the City of Atlantic Beach, after
having given at least three days actual notice of the time
and place of said meeting to the representatives of said clubs.
If as a result of said meeting no satisfactory alternative
is found to abate such nuisance, then said birds may be destroyed
in such numbers and in such manner as is deemed advisable by
said health authorities under the supervision of the Chief of
Police of the City of Atlantic Beach, Florida.
Section 3. Anyone violating the provisions of this
ordinance shall be punishable by a fine of not score than 8100.00
or imprisonment not (=ceding 30 days.
Section 4, This ordinance shall take effect immediately
upon its passage and publication as required by law.
