Ordinance No. 95-61-4 v ORDINANCE NO. 9 S-to /- 9- AN ORDINANCE Regulating the keeping of dogs in the City of Atlantic Beach, Florida; Providing for the Registration and Tagging of all Dogs kept within the limits of said City; Authorizing the Impounding of Unregistered and Untagged Dogs and the Dispossession and Destruc- tion of unredeemed impounded Dogs; and Providing Penalty for Violation of the Provisions of this Ordinance BE IT ENACTED by the People of the City of Atlantic Beach, Florida: Section 1. No dogs, Male or Female, shall be owned or kept in the City unless properly registered and tagged as hereinafter provided. The City Clerk shall require, prerequisite to registration, proof showing that such dog has been inoculated against rabies within one year imme- diately prior to any application for such registration. The certificate of a veterinarian, licensee to practice veterinary medicine and surgery by the Board of Veterinary Examiners of the State of Florida, shall be accepted as conclusive evidence to the fact and time of such inocu- lation. Section 2. No person shall be allowed to keep any dog, Male or Female, in the city unless the person shall first register such dog with the City and purchase from the City an identification tag for each dog for the sum of two dollars per annum. The tag is to be attached to each dog's collar and worn continuously. The City shall upon issuance of the tag, make a record of the name and address of the owner of :'he dog, the number of the tag, the physical description of the dog, and the date the tag was issued. The tags shall be metal and be numbered and issued in regular sequence. Licenses shall be due and payable the first day of June of each year. Section 3. Any unlicensed or untagged dog found running at large on any of _the public streets, parks, playgrounds, alleys, beaches or vacant lots in the city shall be picked up by a designated authorized agent and placed in a shelter for a period not to exceed seven days. - 1 - Any licensed dog that may be committing a nuisance, • and found running at large on any of the public streets, parks, playgrounds, alleys, beaches, or vacant lots in the city is subject to being picked up by the designated authorized agent and placed in a shelter for a period not to exceed seven days. The dog or dogs may be redeemed by the owner thereof upon identifying same and by paying the cost of feeding for the period confined and any other expenses including compliance with the license requirement before the dog is released. The License fee will be double the fee in effect on the date the dog is picked up. At the expiration of seven days, if the dog has not been redeemed by the owner, then the dog or dogs shall become the property of the authorized agent, who may arrange for the disposition of the dog or dogs in a humane manner. The owner of any licensed and tagged dog picked up will be notified. Section 4. If a dog is suspected of having rabies, or has been bitten by another animal suspected of having rabies, such dog shall be confined on the owner 's pre- mises and the Humane Society or a licensed veterinarian notified at once. The dog shall then be removed to the proper place for observation for a period of two weeks at the expense of the owner. Section 5. It shall be unlawful for any person who shall own or be in control of or in charge of any dog, to allow or permit such dog to wander or stray upon the pro- perty of another and damage such property. In the event any such dog shall wander or stray upon the property of any person within the corporate limits of the city and shall cause damage thereon, proof of such damage and the ident-=ty of the dog shall be sufficient to convict the person owning or having charge of or control of the dog of violating the terms and provisions of this article. Section 6. In the event any person is bitten by a dog within the corporate limits of the city then it shall become the duty of such person and the owner of the dog, with knowledge thereof, to immediately report such incident to the police department of the city, who in turn must notify the Duval County Health Officer. Section 7 . It shall be unlawful for any owner or keeper of any vicious dog to permit such dog to run at large or without the enclosure of the owner or keeper thereof within the corporate limits of the city without - 2 - 0 . 0 being properly muzzled. Any dog known to have bitten any person is hereby defined as a "vicious dog" but the term "vicious dog" shall not be limited to only these dogs who are known to have bitten any person. Section 8. No person shall in any manner inter- fere with, prevent or hinder any officer or person mentioned in this ordinance in the performance of any duty required by this ordinance, and no person, not being required by this ordinance, and no person, not being the owner or possessor of such dog, shall re- move or take off, or cause to be removed or taken off, the collar or tag of any dog within the city. Section 9. Any person violating any of the provi- sions of this ordinance, shall upon conviction be punish- ed by a fine not to exceed $100.00, or by imprisonment in the City Jail not to exceed 30 days, or by both such fine and imprisonment. Section 10. This Ordinance shall become effective immediately upon its passage. Passed by the City Commission on first reading, /,li4.,.is 3 ;e(N., 1961.
