Ordinance No. 95-64-7 v ORDINANCE NO. 95-64-7 62-'4 C '7 s - 7" AN ORDINANCE REGULATING THE KEEPING OF PETS IN THE CITY OF ATLANTIC BEACH, FLORIDA; PROVIDING FOR THE VACCINATION, REGISTRATION, LICENSING AND TAGGING OF DOGS AND CATS KEPT WITHIN THE LIMITS OF SAID CITY: AUTHORIZING THE IMPOUNDING OF UNTAGGED DOGS AND CATS, AND OF TAGGED DOGS AND CATS IN SPECIFIED CIRCUMSTANCES; AUTHORIZING THE DISPOSITION AND DESTRUCTION OF UN- REDEEMED IMPOUNDED DOGS AND CATS; AND PROVIDING PENALTY FOR VIOLATION OF THE PROVISIONS OF THIS ORDINANCE. BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA: SECTION 1. DEFINITIONS : Wherever used the following terms shall 'be_ interpreted as follows; (a) The term "dog" shall mean and include all members of the canine family, male and female, three months or more of age, this includes pet foxes, wolves, etc. (b) The term "cat" shall mean and include all domestic felines, four months or more of age. (c) The term "owner" shall mean and include any person having a right of property in a dog or cat, or who keeps or harbors a dog or cat, or who has it in care or in custody. (d) The term "vaccination against rabies" shall mean the proper administration of anti-rabies inoculation or vaccination by a veterinarian licensed by the Board of Veterinary Examiners of the State of Florida. SECTION 2. REGISTRATION, LICENSE AND TAG: (a) No owner may keep any dog or cat unless such owner shall have registered the dog or cat with the City Clerk of this City and has obtained the license and identification tag attesting to such registration. A prerequisite for registration is the submittal to the City Clerk of a certificate of vaccina- tion showing that the dog or cat was vaccinated within one year prior to date of application for registration. The City Clerk shall, upon issuance of license and tag, make record of owners name and address, ; the number of the tag, the physical descript- ion of the dog or cat and the date of issue. (b) Registration and license remain in effect, or valid, for a period of one year commencing June 1st each year. One- half year license may be issued after November 30th at one-half cost of full year license. Registration, licensing and issuance of tag shall constitute a purchase from the City in the amount of $2.00 for dogs, and in the amount of $1.00 for cats. (c) Tags shall be of light weight metal, shall bear the words ATLANTIC BEACH, the numbers representing the calendar year and serial numbers in accordance with which the tags shall be issued. Tags for dogs shall have surface area spproximately that of a U. S . Quarter Dollar; tags for cats, surface area approximating the area of a U. S. One Cent. Shape of tags to be varied from year to year. The tag shall be permanently attach- ed to collar or harness of the specific animal for which issued, and must be worn at all times. SECTION 3 . IMPOUNDMENT: (a) Any untagged dog or cat running at large on any of the public streets, parks, playgrounds, alleys, vacant lots or on the beach of this City, or upon property of any person making complaint regarding trespass of such dog or cat upon his premises, shall be taken up by an authorized agent of the City and confined, or impounded, in a suitable shelter. (b) Any tagged dog or cat running at large, that may be, or may have been, committing a nuisance such as defecation, urination, digging, fighting, howling, lengthy barking or squalling on any of the public streets, parks, playgrounds, alleys, vacant lots or on the beach of this City, or upon pri- vate property of any person making complaint regarding trespass of such dog or cat upon his premises, shall be taken up by an authorized agent of the City and confined, or impounded, in a suitable shelter. (c) Any dog or cat confined, or impounded, which shows evidence of disease, or of vicious nature, shall be confined apart from other dogs or cats. The impoundment shelter shall have entirely separate spaces available for confinement of dogs and cats. (d) The owner of any impounded dog or cat shall be noti- fied of such impoundment if owners identity can be clearly established by any means, and such owner may redeem the dog or cat by payment of the cost of feeding for the period of confine- ment; and if the animal is unregistered, or overdue for re- registration, payment of a registration fee double that for regular registration; that is, $4.00 for dog, and $2.00 for cat. Impounded dogs and cats which remain unredeemed more than seven days shall be destroyed in a humane manner by duly authorized agent, or agency, of the City; • A M • SECTION 4. RABID OR VICIOUS ANIMALS : (a) A dog or cat suspected of having rabies, or one bitten by any animal suspected of having rabies, shall be con- fined on the owner 's premises. The City Police Department shall be immediately notified of such suspicion or accident and, in accordance with the then current requirements of the Duval County Health Officer, said Police Department shall issue instructions as to further isolation, observation and treatment of such dog or cat. (b) If any person is bitten by a dog or cat, the likeli- hood of rabies infection is assumed. Accordingly, it shall be the duty of the person so bitten, the duty of the animal ' s owner, and the duty of any person observing such incident to report it immediately to the City Police Department which, in turn shall immediately notify the Duval County Health Officer who will issue further instructions. The dog or cat in this case shall be immediately confined separately from any other animals and held available for any further action which the County Health Officer may require. (c) Any dog or cat known to have bitten a person, and which has been proven free of rabies infection to full satis- faction of the County Health Officer shall be deemed to be a vicious dog or cat. Such animal shall not be allowed to run at large; shall be kept within a secure enclosure on premises 1 c • of its owner, or held on leash when outside such enclosure for IL) exercise. j �� j SECTION 5.
