ORDINANCE NO. 9 s ' Co 7
AN ORDINANCE PROHIBITING INDECENT EXPOSURE
AND THE PROCURING, AIDING OR ABETTING OR
PERMITTING THE SAME, AND PROVIDING PENALTIES
FOR VIOLATION THEREOF.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH,
FLORIDA,
Section 1. It shall be unlawful for any person in any public
or private place to which the public is invited, to wilfully
expose his or her person, or private parts thereof, including
in the case of any female person above the age of twelve
years the wilful exposure in any such place of her bosom or
breasts, in the presence of one or more persons of the
opposite sex.
Section 2. It shall be unlawful for any person to aid or abet or
to procure another to commit any act made unlawful by Section 1
hereof.
Section 3. It shall be unlawful for any person to take part in
any immoral show, exhibition or performance where indecent,
immoral or lewd dances or plays are conducted in any public or
private place to which the public is invited.
Section 4. It shall be unlawful for any person to permit the land,
buildings, or premises of which he is owner, lessee or tenant, to
be used for the commission of any act made unlawful by Section 1
or Section 2 hereof or for any immoral purpose.
Section 5. The City Commission hereby declares that should any
section, paragraph, sentence, or word of this Ordinance be de-
clared for any reason to be invalid, it is the intent of the City
Commission that it would have passed all other portions of this
Ordinance independently of the elimination herefrom of any such
portion as may be declared invalid.
Section 6. Any person violating any provision of this Ordinance
shall be fined not to exceed $500.00 or imprisoned for a term of
not exceeding 90 days or by both such fine and imprisonment in
the discretion of the Municipal Court.
Section 7 . This Ordinance shall become effective immediately
upon its passage on final reading.
