ORDINANCE NO . 95-75-14
AN ORDINANCE PROVIDING FOR THE SALE,
DESTRUCTION OR DISPOSAL OF UNCLAIMED
OR CONFISCATED PERSONAL PROPERTY.
BE IT ENACTED BY THE PEOPLE OF THE CITY OF ATLANTIC BEACH, FLORIDA
SECTION I . SALE OF CONFISCATED PROPERTY. When requested by the
Chief of Police, and in the time and manner ordered by the
Municipal Judge, any personal property entered into evidence or
otherwise coming into the custody of the Municipal Court of the
City of Atlantic Beach during the progress of any case, and not
claimed by, or returned to the owner, or any person claiming
interest therein within sixty (60) days, shall, if of any appre-
ciative value, be sold, or offered for sale, at public sales
conducted by the City Clerk. If no claim is made within thirty
(30) days after a sale, proceeds shall be paid over to the General
Fund.
SECTION 2 . SALE OR LOST AND FOUND PROPERTY. All lost and found
properties which have come into the prossession of the Police
Department and have not claimed by the owner or any person claim-
ing an interest therein within ninety (90) days, may, at the re-
quest of the Chief of Police and upon order of the Municipal
Judge, be disposed of by sale in the same manner as described in
Section 1 of this Ordinance.
SECTION 3 . NOTICE OF SALES. Notice of all sales shall be given
by the City Clerk by advertising once each week for two successive
weeks in a newspaper published within the County.
SECTION 4. HOURS OF SALE. All sales of such property shall take
place between the hours of 10:00 A. M. and 2:00 P . M. , any day of
the week except Saturday and Sunday.
SECTION 5 . PLACE OF SALE. All property shall be exposed to sale
at the City Hall, except if the property to be sold shall consist
of merchandise not easily moveable or moved at great relative
expense; then sale shall take place where the property was located
when taken possession of.

SECTION 6. DESTRUCTION OF CONFISCATED, LOST AND FOUND
PROPERTY. If any of such confiscated, lost and found
properties described in Section One and Two above, is
of no appreciative value, the Municipal Judge may order
the destruction of same by the Chief of Police.
SECTION 7. TRANSFER OF UNCLAIMED OR CONFISCATED PROPERTY
TO CITY USE. At the request of the Chief of Police and
on order of the Municipal Judge, any property unclaimed
or confiscated for a period of ninety (90) days or more,,
that can serve a useful, productive service to the City
of Atlantic Beach. may be placed on City inventory and
transferred to any Department within the City.
SECTION 8. DESTRUCTION OF CONFISCATED DRUGS . All confiscated
drugs and drug implements will be destroyed within thirty
(30) days after seizure or as soon thereafter as practical
upon written request of the Chief of Police and upon order
of the Municipal Judge.
SECTION 9. All ordinances or parts of ordinances in con-
flict herewith, be and the same are, to the extent that
same may be in conflict, hereby repealed.
SECTION 10. This ordinance shall take effect upon its
passage.
