410 AN ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF ATLANTIC BEACH, FLORIDA, AMENDING
THE LAST PARAGRAPH OF SECTION 2 OF ORDINANCE
NO. 95-80-21 (CODES ENFORCEPENT ORDINANCE OF
THE CITY OF ATLANTIC BEACH, FLORIDA) RELATING
TO LEGAL SERVICES FOR THE CODES ENFORCEMENT
BOARD; PROVIDING AN EFFECTIVE DATE
BE IT ENACTED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA,
AS FOLLOWS:
SECTION 1. The last paragraph contained in Section 2 of
Ordinance No. 95-80-21 shall be amended by deleting said paragraph's last
two (2) sentences as follows:
"An-attorney-shall-be-appented-by-the-Gity-6emmisslen
te-attend-all-meetings-e€-the-Beard-and-te-asssB-the
Beard-in-the-eenduet-a€-its-bearings---An-atterney
employed-ln-the-hew-Bepartment-a€-the-G4ty;-er
appe4nted-by-the-G4 by-Ge lssien-ier-seek-perpese,
shall-present-all-eases-te-the-Beard."
and inserting in lieu thereof the following:
011111P "The City Attorney shall either be counsel to the Codes
Enforcement Board or shall represent the City by
presenting cases before the Board; but in no case shall
the City Attorney serve in both capacities. Each case
before the Enforcement Board shall be presented by
either the City Attorney or by a member of the adminis-
trative staff of the municipality."
SECTION 2. All ordinances or parts of ordinances in confict
herewith are hereby repealed.
SECTION 3. This ordinance shall take effect imwediately upon
its passage.
