AN ORDINANCE AMENDING THE ORDINANCE CODE OF THE CITY
OF ATLANTIC BEACH; AMENDING CHAPTER 5 TO CREATE
SECTION 5-19, PROVIDING FOR THE CLOSING OF HOWELL
PARK BETWEEN THE HOURS OF SUNSET AND SUNRISE;
PROVIDING PENALTIES; PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH,
FLORIDA
Section 1. Chapter 5 of the Code of Ordinances of the City of
Atlantic Beach is hereby amended to create Section 5-19 which shall read
as follows:
CHAPTER 5
BEACHES AND PUBLIC PARKS
Section 5-19. Howell Park Use Prohibited After Dark.
It shall be unlawful for any person or groups of persons to
congregate in or about or traverse through the area known as Howell Park
between the hours of sunset and sunrise or 8:00 PM and 6:00 AM whichever
is later.
Section 2. Any person violating any provision of this section shall
be guilty of a misdemeanor punishable by a fine not to exceed five
hundred dollars ($500.00) or thirty (30) days in jail or both.
Section 3. This Ordinance shall take effect upon its adoption.
