Ordinance No. 95-89-39 v ORDINANCE NO. 95-89-39 AN ORDINANCE INTRODUCED AND ADOPTED AS AN EMERGENCY MEASURE CLOSING AND VACATING THE NORTHERLY FIVE (5) FEET OF THE THIRTY-ONE (31) FEET EASEMENT OVER THE SOUTHERLY PART OF LOT THIRTY-SIX (36) , SELVA LINKSIDE SUBDIVISION; PROVIDING AN EFFECTIVE DATE. WHEREAS, the foundation of the house on Lot thirty-six (36) Selva Linkside Unit 1 has been constructed to close to a twelve inch water main, and; WHEREAS, the foundation did encroach on the easement for water main approximately 2.4 feet, and; WHEREAS, the developer of said Lot thirty-six (36) has, at his expense, moved said water main a sufficient distance south of the encroachment, and; WHEREAS, the mortgage company requires an abandonment of that portion of the easement into which the foundation of the building encroaches, and; WHEREAS, the City Commission has determined this to be an emergency measure. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA; Section 1. The City Commission hereby release, abandon and vacates the northerly five (5) feet of the thirty-one (31) foot easement over the southerly part of Lot thirty-six (36) as shown on Plat of Selva Linkside Unit One recorded in Plat Book 44, Pages 23 and 23A of the Public Records of Duval County and further shown on the attached survey. Section 2. This Ordinance enacted as an emergency measure in order for the owner to close the loan on the house which did encroach on the easement.
