Ordinance No. 95-90-46 v ORDINANCE NO. 95-90-46 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ATLANTIC BEACH, AMENDING CHAPTER 18, SOLICITORS, AMENDING SECTION 18-1 TO DEFINE THE TERM "HAWKER"; AMENDING SECTION 18-2 TO ADD SUBPARAGRAPH (4) PROHIBITING HAWKING; AMENDING SECTION 18-21 TO ADD ADDITIONAL EXCEPTIONS; PROVIDING AN EFFECTIVE DATE BE IT ORDAINED BY THE CITY COPM'IISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA: Section 1. Chapter 18, Article 1, Section 18-1 is hereby amended to read as follows: CHAPTER 18. SOLICITORS ARTICLE 1. IN GENERAL Section 18-1. Defined The term "solicitor," for the purpose of this chapter, means a person who goes from door to door visiting multifamily or single-family dwellings for the following purposes: (1) To sell any goods, wares or merchandise or accept subscriptions or orders therefor; (2) To accept or request donations for any charitable purpose The term "Hawker," shall mean any person who shall rent or sell or offer to sell at wholesale or retail any commodity, product, goods, wares, or merchandise of any kind from a stand, wagon, parked vehicle, container, push cart or tent upon any street or public property or any vacant private property. Section 18-2. Prohibited Acts. No person shall: (4) Be engaged as a hawker within the corporate limits of the city or on the city beach Section 2. Chapter 18, Article II, Section 18-21 is hereby amended to add subparagraph (6) as follows: PAGE TWO ORDINANCE NO. 95-90-46 CHAPTER 18 SOLICITORS ARTICLE II. PERMIT Section 18-21. Exceptions The provisions of this chapter shall not apply to: (6) Any person exempted by F.S. 205.192 Section 3.
