A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH,
FLORIDA, AUTHORIZING THE CITY TO CONTRACT WITH ACON
CONSTRUCTION TO PROVIDE CONSTRUCTION SERVICES FOR THE
CONSTRUCTION OF A SPLASH PAD AT DONNER PARK AT A PRICE NOT TO
EXCEED $529,500 AND PRE -PURCHASE THE SPLASH PAD AMENITIES FROM
WATERPLAY AT A PRICE NOT TO EXCEED $78,000; AUTHORIZING THE CITY
MANAGER TO EXECUTE CONTRACTS AND PURCHASE ORDERS IN
ACCORDANCE WITH AND AS NECESSARY TO EFFECTUATE THE PROVISIONS
OF THIS RESOLUTION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, splash pads offer many benefits to communities. They are safe, fun, and refreshing venue
for children to cool off on hot days; they can help promote physical activity and community engagement; they
are relatively low -maintenance; and they are environmentally friendly; and
WHEREAS, the City's Parks Master Plan envisions adding a splash pad as an amenity at Donner Park;
and
WHEREAS, funding in the amount of $607,500 is in place in the City's Fiscal Year 2022-23 budget to
pay costs associated with the construction of a splash pad at Donner Park; and
WHEREAS, the City desires to pre -purchase the splash pad amenities from WaterPlay at a price not to
exceed $78,000; and
WHEREAS, the City will be "piggy -backing" and retaining the construction services procured in the
ACON Construction contract with the City of Jacksonville, as authorized by Section 2-336(6), City Ordinance
Code; and
WHEREAS, the City desires to contract with ACON Construction to provide construction services for
the project, including installation of the WaterPlay amenities, at a price not to exceed $529,500.
NOW THEREFORE, be it resolved by the City Commission of the City of Atlantic Beach as follows:
SECTION 1. The City Commission hereby authorizes the City to contract with ACON Construction to
provide services for the construction of a splash pad at Donner Park at a price not to exceed $529,500 and pre-
purchase the splash pad amenities from WaterPlay at a price not to exceed $78,000.
SECTION 2. The City Commission hereby authorizes the City Manager to execute contracts and purchase
orders in accordance with and as necessary to effectuate the provisions of this resolution.
SECTION 3. This Resolution shall take effect immediately upon its passage and adoption.
