03-A vBE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH: SECTION 1. That the Mayor and Town Council hereby find and declare the necessity of forthwith constructing a seawall and hereby approve the construction thereof in accor- dance with and as contemplated by the plans and specifications now on file with the Town Clerk and hereby provide, by this ordinance, for the payment of the costs and expenses of such construction of said seawall. SECTION 2. That for the purpose of paying and defray- ing the costs and expenses of such construction of said seawall, the Mayor and Town Council of the Town of Atlnatic Beach, a mu- nicipal corporation established and existing in Duval County, Florida, acting in their corporate capacity, under the provisions of Chapter 16311, Number 86, of the Laws of Florida, hereby pro- vide for by ordinance the issuance and sale of seawall bonds, 125 in number and numbered consecutively from 1 to 125 both inclusive, to be known as "Town of Atlantic Beach Seawall 3onds, Issue of 1933", each bond being of the denomination of ONE 1 THOUSAND DOLLARS (1,000.00) each, bearing interest at the rate not more than of/__six per cent. per annum, Payable semi-annually and also include the number of bond and when each matures. SECTION 3. That the said bonds so issued under the provisions of this ordinance and the provisions of the legisla- tive act as aforesaid, shall not be made to mature at a date later than t$:'enty years from the date of the issuance of said bonds. i ) 1 SECTION 4. Special assessments for the improvements herein authorized shall be payable by the owners of property abutting upon said improvements, and the principal and interest of such special assessment shall be determined and pro-rated according to the frontage of the respective properties specially benefited by the said improvement. The portion of the cost to be borne by the Town of Atlantic Beach shall be paid from ad valorem tax to be levied against all the taxable property in the I municipality. Said ad valorem tax shall not exceed in cost an amount greater than the limit set forth in the legislative act providing for this ordinance. SECTION 5. For the ourpose of this ordinance, in order to clarify who is a qualified elector under the charter of said town and the provisions of the legislative act upon which this ordinance is promulgated, a qualified elector is defined in the legislative act and in this ordinance as being one who has re- sided in the said town for thirty (30) days during the calendar year in which an election is held, and in accordance with this act shall register and shall be a free holder and shall be qu =lified as set forth by said act of Legislature. SECTION 6. Tilor the purpose of this ordinance no person participating in this election shall be required to pay poll taxes. SECTION 7. The Town Council is hereby authorized to II incur and pay such reqsonable expenses as may be necessary in the preparation and sale of the said bonds; and is hereby author- ized to incur and pay such reasonable expenses as may be neces- sary in the calling, holding, conducting and canvassing of the election hereinafter provided for. SECTION 8. An election is hereby called to be held on the 8th day of August A. D. 1933, to determine whether or not the issuance of said bonds, as hereinprovided for shall be at that time approved by a majority of the votes cast by the qualified electors of the Town of Atlantic Beach, who are qualified to vote under the laws of the State of Florida and the To 'm of Atlantic Beach, and who are freeholders. Notice of this election shall be given by publishing this ordinance in a newspaper published in Daval County, once each week for four successive weeksvior to said election. SECTION 9. The Town Council shall have pr pared and furnish all necessary blanks and ballots and shall make all other necessary preparations for said election, and shall pay all the expenses of said election out of the general fund of the Town treasury. The ballots to be used in said election shall be in substantially the following form: OFFICIAL BALLOT SPECIAL BOND ELECTION. AUGUST 8th 1933. Directions to Voter: Make a cross mark (X) before the word "FOR" or before the word "AGAINST" as you approve or dis- approve of the bonds proposed to be issued. FOR approval or the issuance of the Fg.XXISMC/XXXIAX Seawall Bonds, issue or 1933 in the sum of One Hundred Twenty-five Thousand Dollars, proposed to be issued. 1 I 1 1 AGAINST approval of the issuance of the MMIIMAXAXIMO5X Seawall Bonds, issue of 1933, in the sum of One Hundred Twenty-five Thousand Dollars, proposed to be issued. Each cross mark on said ballots in front of the word FOR" shall constitute a vote by the elector making such cross mark in favor of the proposition to issue, as provided for in and by this ordinance. Each cross mark on said ballots in front of the fore "AGAINST" shall constitute a vote by the elector making such cross mark against the proposition to issue, as provided for in and by this ordinance. The Town Council shall, as soon as practicable, canvass and declare from the said returns of the inspectors and clerks of election, the results of said election, and their certificate shal be recorded among the records of the proceedings of the Town Council.
