AN ORDINANCE PROVIDING FOR THE CONSTRUCTION

AUTHORIZING AND PROVIDI- G FOR SPECIAL ASSESSMENTS ArAINST ABUTTING
PROPERTYPROPERTY TO PAY A PORTION OF THE COST OF SEAMLLS, AND AUTHORIZING
SPECIAL AD VALOREM TAXES TO PAY FOR A PORTION OF THE COST THEREOF ,
OR THE BONDS ISSUED FOR THAT PURPOSE; AND OTHER .MATTERS IN
CONNECTION THEREWITH OR RELATINGTHERETO.
Be it ordained by the Mayor and Town Council of the
Town of Atlantic Beach , of Duval County, Florida:
Sec. 1. The Mayor and the Town Council hereby find
and declare the public necessity for forthwith or as early as
practicable , constructing a seawall , and hcreby 'approve the con—
struction thereof in accordance with plans and specifications now
on file with the. Town Clerk, which said plans and specifications

Sec. 2. The Town Council has heretofore determined

by resolution, the amount of money necessary for the proposed .
improvement , and the portion of the cost thereof which shall be •
borne by the abutting property, and the portion which shall be
borne by general taxation, which said determination is hereby
ratified, approved and confirmed.

costs and expenses of the construction of such seawall , it is
hereby provided by this ordinance for the issuance of bonds in

in the sum of
One thousand ('$1.,000.00) Dollars each, bearing a rate of interest
not to exceed six per tent (63/4) , which shall be due and payable
twenty ( 20) years from the date thereof. Said bonds shall be

dated October 1, A. D. 1933; interest shall be payable semi—annually.
Section 4. It is hereby provided that the principal
and interest shall be paid from the proceeds from the special
assen,ssments hereiprovided for ; and by general taxation for the
po=tion of the cost thereof, which shall be borne by the Town,
and for the portion of the cost thereof to be borne by the Town,
the entire taxable property in the Town shall be hereby pledged.
The portion f the cost to be borne by the abutting property shall
be v`0 per cent of the total cost of the proposed improve—
ment , and the portion of t e proposed improvement to be borne by
the. Town shall be 77 ! per cent of the total cost of the
proposed improvement.
Section 5. The said bonds shall only be issued after
the same shall be approved by the majority of the votes cast in an
election in which a majority of the free-holders- who are qualified - "
electors residing in said Town shall participate.
Ost Section 6 . For the purpose of this ordinance , no
person participating in said election shall be required to pay poll
taxes , and the said election shall be held as provided for by
Chapter 16311, Laws of Florida, 1933,
Section 7. The Town Council is hereby authorized to
incur and pay such reasonable expenses as may be necessary in
holding said election, and in the preparation and sale of said bonds.
Section 8. An election is hereby called to be held on
the 31st day of August , A. L. 1933, to determine whether or not to
issue said bonds as herein provided. Notice of this election shall
be given by publishing this ordinance in a newspaper of general
circulation published in Duval County, Florida , once each week for
four successive weeks , prior to said election.
Section 9. The Town Council Niall have prepared and 3

furnish all necessary blanJs and ballots and 'shall ,make. all other

necessary preparations for -said election, and shall pay all the
expenses of said election out of the general fund of the Town
treasury. The ballots to be used in said election shall be in
substantially the following. form:
