015-B vOrdinance No . _,5_ 6 AN ORDINANCE Providing for the Determination and Abatement of Nuisances Created by the Uncontrolled Growvh of Grasses , 'Weeds, and Underbrush, and the Accumulation of Trash and Debris , Within the Corporate Limits of the Town of Atlantic Beach, Florida ; and Prescribing Certain Penalties for the Violation Thereof: BE IT ORDAINED BY THE IWIAYOR .AND TO AU COUNCIL OF THE TOWN OF ATLANTIC BEACH, FLORIDA: Section l: vdhenever the Town Council of the Town of Atlantic Beach, Florida , determines, in the reasonable exercise of its discretion, and by resoluuion duly enacted, that the commingled and concerted growth of weeds , grasses and underbrush , or either of them, or that an accumulation of trash and debris in any part of or upon any property within the corporate limits of the said Town, amounts to and constitutes a nuisance endangering the general health, safety, and welfare of the community at large , then the following procedure is hereby authorized ani declared valid: a) The May-3r of the said Town shall immediately direct a letter to the owner of such property, stating in said letter the anteced- ent action of the Council as aforesaid; and requiring such owner , at the risk of incurring the penalty hereinafter prescribed in Section 2 of this Ordinance , to abate the said nuisance within 30 days after date of said letter. b ) Should such addressee property owner nevertheless allow such nuisance to exist beyond the aforesaid 30 day period , then the Town of Atlantic Beach is hereby authorized and empowered to enter upon such property of the said owner and forthwith destroy or otherwise abate the offending weeds, grasses, and underbrush, or the accumulated trash and debris , by respectively cut ,ing,burning, removing, or any other method which to the City Supervisor of said Town might at the time seem expedient . Section 2: Anyone who , although receiving a letter from the said Mayor written by virtue of and in accordance with Sections 1 and 1 (a) hereof , ignores the said letter for the aforesaid period of 30 days from the date thereof' , and allows the nuisance of which complaint is made to remain unabated for such period of time , is, upon the 31st day after the date of said leiter, guilty of a misdemeanor; and upon conviction therefor shall be subject to the imposition, in the discretion of the municipal judge , of either or both of the following penalties, to-wit: a) A fine of Five (5.00) Dollars for each several day subsequent to the 30th day from the date of the aforesaid letter upon which the said nuisance remains unabated. b ) Imprisonment for a period of time not -to exceed. 30 days.
