AN ORDINANCE Regulating the riving of Motor Vehicles
within the Corporate Limits of the Town of Atlantic Beach, Florida;
and Prescribing Certain Penalties for the Violation Thereof:
BE IT ORDAINED BY THE MAYOR ANI) TOWN COUNCIL OF THE TOWN
OF ATLANTIC BEACH, FLORIDA;
Section 1. That it shall be unlawful for any person below
the age of fourteen (14) years to drive or operate any motor vehicle
within the corporate limits of the Town of Atlantic Beach, Florida.
Section 2. That it shall be unlawful for any person to drive
any motor vehicle within the corporate limits of the said Town while
such person is drunk or under the influence of intoxicating beverages.
Section 3. That it shall be unlawful for any person to drive
any motor vehicle within the corporate limits of said Town in a care-
less and reckless manner.
Section 4. That it shall be unlawful for any person to drive
any motor vehicle within the corporate limits of said Town at a rate
of speed in excess of twenty-five (25) miles per hour.
Section 5. That it shall be unlawful for any person driving
any motor vehicle to pass any other moving motor vehicle at or on any
street intersection within the corporate limits of said Town.
Section 6. That it shall be unlawful for any person, firm
or corporation, to operate or drive any motor vehicle within the
corporate limits of said Town unless said Motor vehicle is in good
mechanical condition and has thereon the necessary appliances to safe-
guard the lives and persons of the public; and any such motor vehicle
having two headlights plainly visible in the night-time, one rear
light plainly visible in the nighttime, brakes which comply with the
pertinent requirements of the laws of the State of Florida and of
i)uval County, properly and adequately inflated rubber tires on all
wheels of such motor vehicle , and ample and adequate steering
appliances, shall be deemed sufficiently equipped with the necessary
appliances within the meaning of this section.
Section 7 . That it shall be unlawful for any person to
drive any motor vehicle within the corporate limits of said Town,
using bright and blinding headlights, spot lights , or any other light-
ing appliances which impede, hinder and distort the vision of other
drivers lawfully on the streets and highways at the same time.
Section 8. That it shall be unlawful for any person to un-
necessarily sound the horn, use muffler cut-outs, or employ any other
mechanical means of sound-making on any motor vehicle within the cor-
porate limits of said Town.
Section 9. That it shall be unlawful for any person to park
any motor vehicle on any street within the corporate limits of said
lawn in such a manner as to leave the right front and rear wheels of
such motor vehicle in a position more than twelve inches from the
curbing line on said street, or to park such motor vehicle within ten
feet of any fire hydrant , or in front of any driveway or alley, or at
the intersection of any street , roadway or right of way, or in front of
any foot passage to street-ends, parkway , park or public building.
Section 10. That it shall be unlawful for any operator of
any motor vehicle to carry passengers within the corporate limits of the
said Town on the running board, fender or other outside part of such
motor vehicle.
Section 11. That it shall be unlawful for any person to
drive away or flee from the scene of any motor vehicle accident in
which the person so driving or fleeing has been a participant .
Section 12. It shall be unlawful for any operator of a
motor vehicle within the corporate limits of the said Town to run
down any pedestrian or bicyclist , or to overtake and collide with any
other motor vehicle, or to drive in such close proximity to any such
other motor vehicle that the lives and persons of the occupants
thereof, and of the public, are thereby endangered,
Section 13. Zhat any person , firm or corporation violating
any of the provisions of this Ordinance shall, upon conviction, be
punished by fine not exceeding five hundred ($500.00) dollars, or by
imprisonment for a period not exceeding ninety (90) days, or by both
fine and imprisonment within the respective limitations as aforesaid.
Section 14. That all Ordinances or parts of Ordinances in
conflict herewith shall be, and the same are hereby repealed; and
that this Ordinance shall take effect at and immediately from the
date of its passage .
