AN ORDINANCE Calling a Special Election for the Submission to the
Qualified Electors of the Town of Atlantic Beach, Florida , for the Approval
or Disapproval by said Electors, of Municipal Ordinance No. 440 , Entitled:
AN ORDINANCE Granting Unto the City of Jacksonville , Florida, a Municipal
Corporation, the Exclusive Franchise , Right and Authority to use the Public
Streets of the Town of Atlantic Beach for the Construction and Maintenance of
an Electric Distribution System within the Town Limits of Atlantic Beach,
Florida ; and , as a Part of said System, for the Purpose of placing Poles
and Electrical Apparatus and Conduits,Wires and Cables thereon, and Underground
Conduits and Raceways for Electrical Apparatus, Wires and Cables under the Same ,
and the Exclusive Franchise , Right and Authority to Furnish Electricity within
the Town Limits of the Town of Atlantic Beach, Florida , and Providing for
Arbitration, Forfeiture, and other Regulatory Matters"
BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF

Section 1: An election is hereby called to be held on theAV
day of OLQ41'' , 1939 , to determine whether or not Ordinance No. 'IC
of the Town of Atlantic Beach, Duval County, Florida, entitled "AN ORDINANCE
Granting Unto the City of Jacksonville , Florida, a Municipal Corporation, the
Exclusive Franchise Right and Authority to Use the Public Streets of the Town
of Atlantic Beach for the Construction and Maintenance of an Electric Distribut—
ion System within the Town Limits of Atlantic Beach,Florida ; and, as a part
of said System, for the Purpose of Placing Poles and Electrical Apparatus and
Conduits , Wires and Cables thereon, and Underground Conduits and Raceways for
Electrical Apparatus , ";'Mires and Cables under the Same , and the A'xclusive

Section 2: The following described Notice shall for thirty
consecutive days prior to said date of J8 ; 1939, be published
by the posting thereof at (1) The Town Hall o said Town, (2) the United
States Post Office at said Town, and (3) at one other public place in said
Town selected by the City Supervisor thereof:

TO ALL QUALIFIED ELECTORS OF THE TOO' OF ATLANTIC
BEACH,DUVAL COUNTY,FLORIDA: A MUNICIPAL CORPORATION:
You, and each of you, are hereby notifiethat a special el-

ection will be held on the /Cj- day of
at the Town Hall of said Town, from eight o' clock in the
fore-noon until sun down, for the purpose of then and there secur-
ing the approval or disapproval, by the qualified electors of
the Town of Atlantic Beach, Florida, of that certain Municipal
Ordinance No. 410 , entitled: AN ORDINANCE Granting unto the
City of Jacksonville , Florida , a Municipal Corporation, the Ex-
clusive Franchise, Right and Authority to Use the Public Streets
of the Town of Atlantic Beach for the Construction and Maintenance
of an Electric Distribution System within the Town Limits of
Atlantic Beach,Florida; and, as a part of said System, for the
Purpose of Placing Poles and Electrical Apparatus and Conduits ,
Wires and Cables thereon, and Underground Conduits and Raceways
for Electrical .Apparatus , Wires and Cables under the Same, and
the Exclusive Franchise , Right and Authority to furnish Electri-
city within the Town Limits of the Town of Atlantic Beach, Florida,
and Providing for Arbitration, Forfeiture , and other Regulatory
Matters".
of said Ordinance is now on file for public inspection at the
said Town Hall.
Kindly govern yourselves accordingly.
Section 3: A true and correct certified copy of said
Ordinance No. /IC shall continuously at all times between the hours of eight
o' clock A.M. , and five o' clock F.M. , be available for public inspection at the
said Town Hall from the date of passage hereof to and including the said 4 _
day of i 1939 , upon which latter date said election shall be held as

herein provided.
Section 4: The Town Council shall have prepared and furnished
all necessary blanks and ballots and shall make all other necessary preparat-
ions for said election, and shall pay all expenses of said election out of the
contingent fund of the Town Treasury. The ballots to be used in said election
shall be in substantially the following form:

word "For" or before the word "Against" , accordingly as you
approve or disapprove Town of Atlantic Beach Ordinance No.4"C .

entitled "AN ORDINANCE Granting unto the City of Jacksonville ,
Florida, a Municipal Corporation, the Exclusive Franchise , Right
and Authority to use the Public Streets of the Town of Atlantic
Beach for the Construction and Maintenance of an Electric Dis-
tribution System within the Town Limits of Atlantic Beach,Florida;
Authority to Furnish Electricity within the Town Limits of the
Town of Atlantic Beach, Florida, and Providing for Arbitration,
Forfeiture, and other Regulatory Matters".
Against approval of said Ordinance No. qO ,
entitled "AN ORDINANCE Granting unto the City of Jacksonville ,
Florida , a Municipal Corporation, the Exclusive Franchise ,Right
and Authority to Use the Public Streets of the Town of Atlantic
Beach for the Construction and Maintenance of an Electric Dis-
tribution System within the Town Limits of Atlantic Beach,Florida ;
and , as a part of said System, for the Purpose of Placing Poles
and Electrical Apparatus and Conduits , Wires and Cables thereon ,and
Underground Conduits and Raceways for Electrical Apparatus ,Wires
and Cables under the Same , and the Exclusive Franchise,Right and
Authority to Furnish Electricity vithin the Town Limits of the
Town of Atlantic Beach,Florida , and Providing for Arbitration,
Forfeiture , and other Regulatory Matters".
Each cross mark on said ballots in front of the word "For"
shall constitute a vote, by the elector making such cross mark, approving
said Ordinance No.d_; each cross mark on said ballot in front of the
word "Against" shall constitute a vote, by the elector making such cress
mark, disapproving said Ordinance No. I/O ; and if three-fifths (3/5ths) o
the votes cast as hereinabove provided shall be "For" approval of
said Ordinance No. /C , then the said Ordinance shall then and there,
according to the provisions of Section 16 thereof, become effective .

Section 5: The Town Council, at least six days before the
date of said election, shall appoint two (2) Inspectors and One (1) Clerk
of Election to hold said election in the said Town. If any Inspector or
the Clerk of Election so appointed shall fail to attend at the proper
polling place at the time for opening the polls on the day of the election,
the Inspector present shall fill the vacancy or vacancies; and if all the
Inspectors be absent , then those persons present qualified to vote at
said election shall fill the vacancies. The Polls shall be opened at eight
o' clock in the fore-noon and closed at sun down, with an intermission of
one half an hour between twelve and one o' clock, and shall be located at
the polling places used in the last Tcwn general election; to-wit , the
Town Hall. The Inspectors and Clerk of Election shall make out and sign
duplicate returns of said election, and shall deliver one copy thereof to
the Town Clerk, and one copy to the President of the Town Council, and
said returns shall show the total number of the qualified electors of
said Town actually voting at said election, and the number of votes
cast respectively "For" and "Against" the approval of said Ordinance No.
The Town Council shall, as soon as practicable , canvass, and
declare , from the said returns of the Inspectors and Clerk of said electiol
the results of said election; said results to show ( 1) the total number of
the qualified electors actually voting at said election, and (2) the
number of votes cast respectively "For" and "Against" the approval of the
aforesaid Ordinance No. /e2 . The Town Council shall then cause such
results of the said election to be duly recorded in the Minutes of the
said Council.
Said election shall in all other respects be conducted as
nearly as may be in compliance with the laws regulating the holding, return
ing, certifying, and canvassing of general Town elections.
Passed by the Town Council of the Town of Atlantic Beach,
Florida, on first reading, 44C0044,45 ,3 ; 1938; passed by the said
Town Council on second reading•Uez,1 ; 938•, passed the
said Town Council on third and final reading, 7, 1938; and
