AN ORDINANCE Relating to Public Health; Recuiring all
Individuals in the Employ of Certain Persons , Firms or Corporations to
Furnish Certain Health Certificates ; Outlining the Appropriate Procedure
in Obtaining said Health Certificates; Prohibiting said Persons, Firms,
or Corporations from so nnploying said Individuals Failing to Furnish
the said Health Certificates; and Prescribing Certain Penalties for the
Violation Thereof.
BE IT ORDAINED BY THE MAYOR AFD TOWN COUNCIL OF THE TOWN
OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA:
Section 1: Every individual who works in the Town of
Atlantic Beach, Duval County, Florida , either as a motor vehicular or
pedestrian street or itinerant vendor or peddlar, or as an employee in
any restaurant ,cafe,drug store , candy shop or store, sandwich stand,
barbecue stand, butcher shop, bakery, fruit and fish, shrimp, or oyster
stand, tavern, grocery store , or in any other place Cr occupation whatso-
ever devoted in whole or in part to the selling, at either wholesale
or retail, of any manner of foodstuffs or drinks whatsoever designed for
ultimate human consumption, whether or not said food or drink be in bulk
or in sealed containers, and who,in the course of such work, has Jccasion to
handle , either frequently or casually, any of the said foodstuffs or drinks,
must, as a condition precedent to undertaking or continuing such vending or
peddling, or to assuming or continuing such employment , furnish unto the Town
Clerk of the Town of Atlantic Beach, Duval County, Florida, a health certi-
ficate.
Section 2: Said health certificate shall be signed by a
registered licensed physician of the State of Florida, or by the Health
Officer of the Duval County, Florida Health Unit; shall contain such infor-

medical examination conducted prior to and as a basis for the issuance of
the said certiiicate, the therein named individual exhibited no discoverable
traces of a disease either then, or likely in the future to become, infectious
and communicable ; and said health certificate shall be in such form as may
be prescribed by the Health Officer of the Duval County, Florida, Health
Unit. Such certificate shall be prima facie evidence of the fact that
at the time of the medical examination conducted prior to and as a basis for
the issuance of the said health certificate , the therein named individual
exhibited no discoverable traces of a disease either then, or likely in the
future to become , infectious and communicable .
Section 3: For such hereinabove mentioned medical examination
every individual taking the same before the Health Officer of the Duval
County Health Unit may be required to pay a minimum fee of seventy-five
75) cents; and all such fees collected by the Duval County Health Unit
shall be deposited into the treasury of the Advisory Health Council of the
Beaches , and a complete itemized record of all such fees collected and the
names of all individuals from whom collected shall be kept by the Duval County
Health Unit and a complete report thereof shall be periodically furnished to
said Advisory Council at the time of its regular meetings ; and all such funds
as accumulate in the treasury of said Advisory Council shall
be disbursed and used by it for the purpose of defraying the expenses
of operation of said Duval County Health Unit Clinic at the Beaches .
Section 4: No person, firm, or corporation in the said Torn
of Atlantic Beach conducting, as owner, manager, agent , superintendent, or
otherwise , any of the business establishments enumerated in Section 1 of
this Ordinance shall either hire or retain, as servant, agent , or employee
in such business establishment , any individual affected by the terms of said
Section 1 and failing to furnish, as aforesaid, the herein required health

Section 5: The said Town Clerk of the said Town shall, immediate-
ly after the passage of this Ordinance on third and final reading and its
approval by the Mayor , post, under the official hand and seal of the said
Clerk, and for public inspection and perusal , several and respective
true and correct certified copies hereof at (a) the Town Hall of the said
Town of Ittlantic Beach , (b) the United States Post Office in said Town,
and (c) at one other public place in the said Town selected by the said
Clerk; and said copies shall remain at their aforesaid several and respect-
ive places of posting for a period of thirty (30) consecutive days.
Section 6: Every individual who, at the time of the taking
efect of this Ordinance in the manner provided by law is affected by
Section 1 hereof and who is at said time already working as a therein
described motor vehicular or pedestrian street or itinerant vendor or
peddlar, or as an employee in any therein described restaurant , cafe, drug
store, candy shop or store , sandwich stand, barbecue stand, butcher shop ,
bakery, fruit and fish, shrimp, or oyster stand, tavern, grocery store , or
other place or occupation devoted in whole or in part to the therein
described selling of foodstuffs or drinks , is allowed a reasonable time
after such taking effect of said Ordinance in which to procure said
health certificate; and , throughout the duration of this period of grace ,
no person, firm, or corporation affected by Section 4, hereof shall be
deemed violative of the provisions of the said Section because , during
such grace period , the said person, firm, or corporation retains , as a
servant , agent or employee , an individual contemplated in and by the
terms of Section 1, of this Ordinance who, at the time it takes effect
as aforesaid, is already in the employ of such person, firm, or corpor-
ation, and who, at said effective date, has not yet furnished unto the
mntn,n of Atlantic Reach. the herein-required health

Section 7: Any individual, person, firm, or
corporation adjudged guilty of the violation of any applicable
provision of this Ordinance shall, upon conviction therefor , be , in
the discretion of the municipal judge , punished by a fine not
exceeding one hundred ($,'100.00) Dollars or by imprisonment for
a period of time not longer than thirty (30 ) days , or by both
such fine and such imprisonment; and each several days violation
of this Ordinance shall constitute a separate offense within the
purview and meaning of this Section.
