AN ORDINANCE Prescribing the Manner in Which Special
Meetings of the Town Council of the Town of Atlantic Beach, Duval
County, Florida, May be Called and Legally Held.
Whereas , Section 12 of Chapter 13907 , Laws of Florida ,
Special Acts of 1929 , provides in part that "the Town Council (of
the Town of Atlantic Beach, Duval County, Florida) may determine
its own rules of proceeding. . ." , and that "the ( said) Town Council
shall hold meetings at such times as it may determine . . ." , and
Whereas , there is on file and of record in the minute
books of the said Council no Ordinance , Resolution, or duly enacted
Motion providing for the manner in which special meetings of said
body may be called and legally held; now therefore,
BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE
TOWN OF ATLANTIC BEACH, DUVA.L COUNTY, FLORIDA:
Section. 1: Special meetings of the Town Council of the Town
of Atlantic Beach, Duval County , Florida , may, at and for any time
except Sunday, be called by the President of the said Council, acting
in the reasonable exercise of his discretion.
Section 2: Written notice of every such special meeting
shall, over the signature of the said President , be served upon each
member of the said Town Council and upon the Mayor and Town Clerk
of the said Town; either personally, or, in a correctly addressed and
stamped envelope , through the regular course of the United States
Mail; and said notice shall be so served at least five days prior
to the date upon which the therein called special meeting is to be
Section 3: Every such notice shall, with certainty and
precision state:
a) The purpose of said special meeting, and
the business to be transacted thereat ,
b) The date and time of said meeting, and
c) The place of said meeting; which, in every
instance , shall be at the Town Hall of the said Town of Atlantic
Beach.
Section 4: The president of the Town Council of the said
Town shall , at the time of each several special meeting thereof,
called as aforesaid, file with the Town Clerk of the said Town of
Atlantic Beach, a true and correct certified copy of the Notice
of such special meeting theretofore served by such president upon
the Mayor and Town Clerk of the said Town and upon each member of
the said Council thereof as required in and by Section 2 of this
Ordinance, together with the said president' s affidavit of such
service ; and the minutes of said special meeting taken by the said
Town Clerk shall therein reflect, verbatim, both the said true and
correct certified copy of the said Notice , and the said affidavit of
service.
