AN ORDINANCE in Reference to General and
Special Elections in and at the Town of Atlantic Beach,
Duval County,Florida ; Providing for the Registration of
of Electors; Outlining their Qualifications for and Pre-
requisites to Voting; Formally Establishing the Office
of Registration Officer; and Repealing Ordinance No. A-6 ,
Entitled WAN ORDINANCE Providing for the Registration of
Voters in the Town of Atlantic Beach".
Whereas , there has by the governing authority
of the Town of Atlantic Beach, Duval County, Florida , been
no formal appointment of a registration officer to super-
vise and direct the registration of prospective voters for
general and special elections held in and at the said Town,
and
Whereas in and by Section 1 of Chapter 2034, Laws of
Florida , Acts of 1874, it is provided that "the . . . Town Council
shall have full power to establish rules, regulations and fees,
for the registration of voters . . . for such . . . municipal
elections as may be authorized by lain" , and
Thereas , it is the wish and intent of the Town Counci
in and for the said Town of Atlantic Beach,Florida , to promulgate

Town's future system of qualifying and registering electors with
that prescribed by the general laws of this State ; NOW, THEREFORE
BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN
OF ATLANTIC BEACH, DUVL COUNTY, FLORIDA, THAT:
Section 1: Every person of the age of twenty-one years
and upwards that shall, at the time of such person's registration
for any general or special election proposed to be had and held in
the Town of Atlantic Beach, Duval County, Florida , be a citizen
of the United States , and that shall have resided and had his
habitation, domicile , home and place of permanent abode in Florida
for one year and in the County of Duval for six months, and who
is either a freeholder of said Tcwn of Atlantic Beach or a
qualified elector in the State of Florida who shall have resided in
said Town ninety days during the calendar year in which a general
municipal election shall be held, and who shall register as herein
provided, shall be deemed a qualified elector at all aforesaid
general or special elections. Naturalized citizens of the United
States at the time of and before registration shall produce to the
registration officer hereinafter appointed his or her certificate
of naturalization or a duly certified copy thereof, and shall
make oath that they are the identical persons named in such certificate:
before they shall be allowed to register.
Section 2: The following classes of persons shall not
be entitled to register for or vote at any general or special municipal
election hereinafter held in the said Town of Atlantic Beach; viz:
a) Persons not duly registered according to law.
c) Persons who are insane or idiotic .
d) Persons who may have been convicted of
any felony by any court of record.
e) Persons who may have been convicted of bribery,
perjury, or larceny, or of any infamous crime in any court of
this State , or any other State, or interested in any bet or wager,
the result of which shall depend upon any election, or that shall
hereafter fight a duel, or send knowingly, carry or accept a
challenge to fight ,or that shall be a second to either party,
or that shall be the bearer of such challenge or acceptance ; but
the legal disability shall not accrue until after trial and
conviction by due form of law.
f) No person shall be permitted to vote , or
shall such vote be counted, unless the person registers to vote
at the Town Hall in the said Town of Atlantic Beach ,Florida.
Section 3: Every elector shall at the time of his
registration take and subscribe to the following oath:
I do solemnly swear (or affirm)
that I will protect and defend the Constitution of
the United States and of the State of Florida;
that I am twenty-one years of age , and have
been a resident of the State of Florida for twelve
months and of this County for six months; and I
am qualified to vote under the constitution and
laws of the State of Florida.
I do further solemnly swear (or affirm)
that I am a citizen of the United States; that I
that I am (a) a freeholder of said Town, or (b) a
qualified elector in the State of Florida and have
resided in the Town of Atlantic Beach in Duval
County in said State ninety days during this calendar
year in wihich a general municipal election shall
be held ; and that I am qualified to vote under the
law of the said Town of Atlantic Beach, Florida".
The registration officer hereinafter formally appointed is hereby
authorized and required to administer this oath and the elector
shall also be recuired, under oath to be administered by the said
registration officer, to give such description of himself or
herself as will be sufficient to clearly identify his person .i_th
the act of registration.
Section 4: The Town Clerk of the said Town is hereby
appointed ex officio registration officer for all general and

special municipal elections. He shall keep his office at the
Town Hall in said Town; shall have exclusive charge of the registration
of electors ; and for this latter purpose shall open and keep books
suitable for such registration of electors.
Section 5: The said registration officer shall, for every
general and special municipal election, keep the registration book of the
said Town open at -s office every day in the calendar week save
Sunday, from 9 o' clock y.N. , to 12 M. , and from 2 o' clock P.M. , until

5 F.M.., for the registration of elctors ; and such registration bock
shall be so kept open ,from the twenty-fifth day to the sixth day, both
inclusive , before thedate of the holding of such general or special ejection

Section 6: The said registration officer shall have
published, by posting at the said Town Hall, at the post-office
in said Town, and at one other public place in said Town selected
by the said registration officer acting in the reasonable
exercise of his discretion, and on the day after the closing of the
registration book for any municipal general or special election,
a certified list of the registered and qualified electors of said
Town entitled to vote in such election.
Section 7: At the end of the time provided by this
Ordinance for the registration book to be kept open by the said
registration officer the said book shall be closed, and shall not
again be opened for registration until after the general or special
election because of which it was opened; and then only in the manner
provided in and by Section 5 of the Ordinance , supra.
Section 8: The said registration officer shall be the
official custodian of the books of registration, and iit.e shall have
the exclusive control and management of all matters pertaining
to the proper registration of electors at all times.
Section 9: Ordinance No. A-6 , entitled "A'T ORDINANCE
Providing for the Registration of Voters in the Town of Atlantic
Reach" , is hereby expressly repealed.
