051 vI Ordinance No.c$/ AN ORDINANCE Affecting the Government of the Town of Atlantic Beach, Duval County, Florida; Providing for an Increase in the Limit of its Bonded Indebtedness; and Calling a Special Election for the Approval Hereof: BE IT ORDAINED BY TIE;: MAYOR AND TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA: Section 1: Pursuant to and in accordance with the authority and power conferred by Chapter 16314, Laws of Florida, Special Acts of 1933, the limit of the bonded indebtedness of the Town of Atlantic Beach, a municipal corporation in Duval County, Florida, is, subject only to the condition imposed in and by Section 2 hereof, hereby increased from ten percent (10;1 to twenty percent (20;1 of the assessed valuation of the real and personal property within the corporate limits of the said Town, Section 2: Such limit of said bonded debt shall be increased only after this ordinance shall have been approved by the majority of the votes cast in an election in which the freeholders who are qualified elect- ors residing in said Town shall participate, Section 3: Any qualified elector in the State of Florida who has resided in the Town of Atlantic Beach thirty (30) days during this calendar year A. D. 1939, and who shall register as is provided by Ordinance No. 49, of the said Town, and who is a freeholder of said Town, shall be a qualified elector , for the purpose of the election hereby called and directed to be held. Section 4: An election, of which notice is hereby given, is hereby called to be held on the 27th day of October, 1939, to determine given by publishing this Ordinance in its entirety in a newspaper published in Duval County, Florida; and such publication shall be made at least once in each week for four consecutive weeks during said period of thirty (30) days. It is hereby expressly declared and stated as a fact that there is no newspaper published in the said Town of Atlantic Beach , Florida, at the date of this Ordinance; and true and correct certified copies of this Ordinance shall therefore , and as further and additional notice of said election, be posted in at least ten places within the corporate limits of the said Town. The election herein ordered to be held on the 27th day of October, 1939, on which date there will also be held an election at which a,ill be submitted to the voters of the Town of Atlantic Beach the question of the ratification of certain acts enacted by the Legislature of Florida in 1939, shall be held separately from said other election, and it is hereby expressly directed that separate ballot boxes and separate ballots shall be used for the election herein ordered to be held , and separate returns of said election shall be made and canvassed. Section 5: For the election called in and by the terms of this Ordinance , the voters shall register in accordance with the provisions of Chaoter 14715, Laws of Florida, Acts of 1931, and of Ordinance 1;o. 49 of the said Town of Atlantic Beach; and a list of the registered voters shall, in compliance with said Chapter 14715, be prepared and furnished to the hereinafter provided for Inspectors and Clerk of the election. Section 6: The Town Council shall have prepared and furnished all necessary blanks and ballots and shall make all other necessary preparations for said election, and shall pay all the expenses OFFICIAL BALLOT, SPECIAL ELECTION. Directions to Voter: Express your choice by marking a cross mark (X) in the voting square after the words "For Ordinance" or Against Ordinance", accordingly as you approve or disapprove this Ordinance. Ordinance No. entitled, "AN ORDINANCE Affecting the Government of the Town of Atlantic Beach, Duval County, Florida; Providing for an Increase in the Limit of its Bonded Indebtedness; and Calling a Special Election for the Approval Hereof". Against Ordinance : Each cross mark on said ballots in the voting square follow- ing the words "For Ordinance" shall constitute a vote , by the elector making such cross mark, approving this Ordinance; and each cross mark on said ballots in the voting square following the words "Against Ordinance" shall constitute a vote , by the elector making such cross mark, disapproving this Ordinance. If in said election the majority of the votes cast by the participating freeholders who are qualified said Ordinance shall have been approved; and the limit of the bonded indebtedness of said Town of Atlantic Beach, a municipal corporation in Duval County, Florida, shall be increased, as provided in and by Section 1 hereof, from ten percent (10;,) to twenty percent (20 ,2) of the assessed valuation of the real and personal property within the corporate limits of the said Town. But if in said election the majority of the votes cast by the participating freeholders who are qualified electors residing in said Town shall not be "For" this Ordinance, then said Ordinance shall not have been approved; and the limit of the bonded indebtedness of said Town shall not be increased from ten percent (10;x) to twenty percent 20,4 of the assessed valuation of the real and personal property within the corporate limits of the said Town. Section 7: The Town Council, at least six days before the date of said election, shall appoint two (2) Inspectors and One (1) Clerk of Election to hold said election in the said Town. If any Inspector or the Clerk of Election so appointed shall fail to attend at the proper polling place at the time for opening the polls on the day of the election, the Inspector present shall fill the vacancy or vacancies; and if all the Inspectors be absent , then those persons present qualified to vote at said election shall fill the vacancies. The polls shall be opened at eight o' clock in the fore-noon and closed at sun down, with an intermission of one-half an hour between twelve and one o' clock, and shall be located at, or as nearly as possible to, the polling place used in the last Town general election; to-wit, the Town Hall. The Inspectors and Clerk of election shall without delay canvass the vote cast and make out and sign due and duplicate returns of said election, and shall deliver one copy thereof to the Town Clerk, and one copy to the President of the Town Council, and said returns shall show the t ! y total number of residents of the said Town of Atlantic Beach, Florida, legally qualified to participate in the said election, the number of persons actually voting at said election, and the number of votes cast respectively, "For" and "Against" this Ordinance .The Town Council shall, as soon as practicable, canvass, and declare, from the said returns of the Inspectors and Clerk of said election, the results of said election; said results to show (1) the total number of the freeholders who are qualified electors residing in said Town of Atlantic Beach who actually voted at said election, (2) the total number of votes cast respectively "For" and "Against" this Ordinance, and (3) whether or not said Ordinance shall have been approved by the majority of the votes cast in said election. The Town Council shall then cause such results of the said election to be duly recorded in the Minutes of the said Town Council. Said election shall in all other respects be conducted as nearly as may be in compliance with the laws regulating the holding, returning, certifying, and canvassing of general Town elections.
