AN ORDINANCE Providing for the Declaration and Abatement
as Nuisances of Certain Houses , Walks , Sidewalks , or Other Structures,
in the Town of Atlantic Beach, Duval County, Florida , and Imposing
in This Behalf Certain Penalties.
BE IT ORDAIN'-{D BY THE MAYOR AND TOWN COUNCIL OF THE
TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA:
Section 1: When the Town Council of the Town of Atlantic
Beach, Duval County , Florida , acting in the reasonable exercise of
its discretion, determines that any house , walk, sidewalk, or other
structure in the said Town is dangerous or detrimental to citizens ,
or involves an undue risk to the health, morals , convenience , and
safety of such citizens , then the said Town Council may declare such
house, walk, sidewalk, or other structure as a nuisance ; and thenceforth
adopt in connection therewith, either of the following courses:
It may direct the Town Clerk of the said Town
of Atlantic Beach to notify and direct in writing the owner, occupant,
or agent of any house , walk, sidewalk, or other structure declared to
be a nuisance , to remove or repair the same within forty-five days of
the date of said written notification. If such owner, occupant , or
agent refuses so to do , (a) he may be fined Twenty-five (125.00) Dollars,
or imprisoned , or both, for each several day's contumacy of the said Town
Clerk's said notification; or (b) the said Town Council may direct the
City Supervisor and the Town Marshal of the said Town to employ all
necessary means and repair, rebuild, remove , raze , or destroy the s id
nuisance --charging to and collecting from said ov,ner, occupant , or agent,
in an action at law brought by the said Town of Atlantic Beach, if
need be , all costs entailed by such abatement.

Duval County, Florida , on first reading,February , 8th 1941;
Passed by the said Town Council on second reading February _
8 , 1941;
Passed by the said Town Council on third and final reading
May 13 1941; and certified to the Mayor May 16 ,
1941.
