065 vOrdinance No. AN ORDINANCE Calling a Referendum Election for the Approval and Ratification or the Disapproval and Rejection by the Qualified Electors of the Town of Atlantic Beach, Duval County, Florida, of House Bill No. 1508, Laws of Florida, regu- lar session of 1941, entitled "AN ACT (A) to Amend Section 14 of Chapter 13907, Laws of Florida, Special Acts of 1929, En- titled: IAN ACT to Fix the Territorial Limits of the Town of Atlantic Beach, to Provide for Its Government and Prescribe Its Jurisdiction and Powers, ' By Enlarging the Powers of the Town Council of Said Town with Regard to Water Supply Systems, Ad- vertising, Expenditures for Public Health Projects, Building Codes, Garbage Collection and Fees, and Control Over Privately Owned Public Utilities; (B) to Amend Section 27 of Said Chapter 13907, by Removing the Therein Imposed Restriction upon the Total Tax Levy able upon any Property in any One Year; (C) to Amend Section 35 of said Chapter 13907 by Conferring upon the said Town Council Traffic Supervisory Powers Over Certain State and County Roads; and ( D) to Amend Section 39 of said Chapter 13907 by Removing the Therein Imposed Bonded Debt Limit; and to Provide for a Referendum on said Act. " BE IT ORDAINED BY THE MAYOR AND TOWN COUNCIL OF THE TOWN OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA: Section 1: A Referendum Election, of which notice is hereby given, is hereby called to be held on the 21st day of August, 1941, to determine whether or not House Bill No. 1508, Laws of Florida, regular session of 1941, entitled "AN ACT (A) to Amend Section 14 of Chapter 13907, Laws of Florida, Special Acts of 1929, Entitled: IAN ACT to Fix the Territorial Limits of the Town of Atlantic Beach, to Provide for Its Government and Prescribe Its Jurisdiction and Powers, ' By Enlarging the Powers of the Town Council of Said Town with Regard to Water Supply Systems, Advertising, Expenditures for Public Health Projects, Building Codes, Garbage Collection and Fees, and Control Over Privately Owned Public Utilities; (B) to Amend Section 27 of Said Chapter 13907, by Removing the Therein Imposed Restriction upon the Total Tax Levyable upon any Property in any One Year; C) to Amend Section 35 of said Chapter 13907 by Conferring upon the said Town Council Traffic Supervisory Powers Over Certain State and County Roads; and ( D) to Amend Section 39 of said Chapter 13907 by Removing the Therein Imposed Bonded Debt Limit; and to Provide for a Referendum on said Act, " shall at that time be approved and ratified by a majority vote of the qualified electors of the Town of Atlantic Beach, Duval County , Florida, voting in said election to be held for the ratification or rejection of the said House Bill No. 1508; in which election the qualified electors of said Town of Atlantic Beach shall partici- pate. At least thirty (30) days said notice of said election shall be given by publishing this Ordinance in its entirety in a newspaper published in Duval County, Florida; and such publica- tion shall be made at least once in each week for four consecutive weeks during said period of thirty ( 30) days. It is hereby ex- pressly declared and stated as a fact that there is no newspaper published in the said Town of Atlantic Beach, Florida, at the date of this Ordinance; and true and correct certified copies of this Ordinance shall therefore , and as further and additional notice of said election, be posted in at least ten places within the corporate limits of the said Town. Section 2: Any person over the age of twenty-one years who is a freeholder of the Town of Atlantic Beach, and who shall register as is provided by Ordinance No. 49 of the said Town, shall be a qualified elector, for the purpose of the election hereby called and directed to be held. Section 3: For the election called in and by the terms of this Ordinance , the voters shall register in accordance with the provisions of Ordinance No. 49 of the said Town of Atlantic Beach; and for the purpose of determining the total number of qualified electors who, as hereinabove defined, are entitled to participate in said election, it shall be the duty of the Town Council of the said Town to cause to be made up and certified by the Registration Officer having charge of the Registration Book for said election, a list of the names of all qualified electors appearing thereon who are also determined to be qualified to vote in said election. A certified copy of such list of qualified electors who are entitled to participate in said election, shall be furnished to the hereinafter provided for inspectors and clerk of the election at the polling place hereinafter designated, and no person shall be permitted to vote in said election whose name does not appear upon said list. In making up the list of qualified voters under this Section, such investigation shall be made as will warrant the conclusion that all names appearing on said list are qualified to vote in said election, and that said list is a complete list of all voters who are qualified to participate in said election. A copy of said list of qualified electors shall be filed and preserved among the records of the Town Council of the said Town of Atlantic Beach. Section 4: The Town Council shall have prepared and furnished all necessary blanks and ballots and shall make all other necessary preparations for said election, and shall pay all expenses of said election out of the contingent fund of the Town Treasury. The ballots to be used in said election shall be in substantially the following form: OFFICIAL BALLOT, SPECIAL REFERENDUM ELECTION. August 21, 1941, TOWN OF ATLANTIC BEACH. Directions to Voter: Express your choice by marking a cross mark (X) in the voting square after the words "For House Bill" or Against House Bill" , accordingly as you approve and ratify or disapprove and reject said House Bill No. 1508. " Against House Bill . House Bill No. 1508; and each cross mark on said ballots in the voting square following the words "Against House Bill" shall con- stitute a vote, by the elector making such cross mark, disapprov- ing and rejecting the said House Bill No. 1508. If in said election the majority of the votes cast by the qualified electors of the said Town of Atlantic Beach, Florida, voting in said election, shall be "For" the said House Bill No. 1508, then the said House Bill shall have been approved and ratified, and shall, according to Section 5 thereof, become effective immediately upon the official determination of said ratification. But if in said election the majority of the votes cast by the qualified electors of the said Town, voting in said election, shall not be "For" the said House Bill No. 1508, then the said House Bill shall not have been approved and ratified, but shall have been disapproved and rejected; and shall in no wise become effective. Section 5: The Town Council, at least six days before the date of said election, shall appoint two ( 2) Inspectors and one (1) Clerk of Election to hold said election in the said Town. If any Inspector or the Clerk of Election so appointed shall fail to attend at the proper polling place at the time for opening the polls on the day of the election, the Inspector present shall fill the vacancy or vacancies; and if all the Inspectors be absent, then those persons present qualified to vote at said election shall fill the vacancies. The polls shall be opened at eight o' clock in the forenoon and closed at sun down, with an intermission of one-half an hour between twelve and one o' clock, and shall be located at, or as nearly as possible to, the polling place used in the last Town general election; to-wit, the Town Hall. The Inspectors and Clerk of election shall without returns of said election, and shall deliver one copy thereof to the Town Clerk, and one copy to the President of the Town Council, and said returns shall show the total number of electors of the said Town of Atlantic Beach, Florida, legally qualified to partici- pate in the said election, the number of persons actually voting at said election, and the number of votes cast respectively, "For" and Against" the said House Bill No. 1508. The Town Council shall, as soon as practicable , canvass, and declare , from the said re- turns of the Inspectors and Clerk of said election, the results of said election; said results to show (1) the total number of the qualified electors of the said Town of Atlantic Beach who actually voted at said election, ( 2) the total number of votes cast respect- ively "For" and "Against" said House Bill No. 1508, and (3) whether or not the said House Bill shall have been approved and ratified by the majority of the votes cast in said election. The Town Punoil shall then cause such results of the said election to be duly recorded in the Minutes of the said Town Council; and if the said House Bill No. 1508 shall have been approved and ratified by the majority of the votes cast in said election, the said Town Council, in recording, as aforesaid, the results of the said election, shall insert in the said Minutes of the said Council, the following statement: Therefore we , the Town Council of the Town of Atlantic Beach, Duval County, Florida, herein and hereby officially determine , declare, and publish, the ratification of the aforesaid House Bill No. 1508; and hereby solemnly pronounce that from this time forward said House Bill No. 1508, according to Section 5 thereof, is in full force and effect. " Said election shall in all other respects be conducted Section 6: A true and correct certified copy of the entirety of said House Bill No. 1508 shall continuously, at all times save Sunday, from 9:00 o' clock A. M. to 12:00 o' clock M. , and from 2:00 o' clock P. M. until 5:00 o' clock P. M. be avail- able for public inspection at the said Town Hall from the date of the passage of this Ordinance to and including the said 21st day of August, 1941, upon which latter date said election shall be held as hereinabove provided.
